Thanks for your reply and info. I understand most of what your saying i may have not made myself clear to you. I sent a appeal to them aftert getting my assesment back saying i was fit for work so when i rang the DWP they told me what i had to do and what information i had to send was never told i had to get a sick note also form my GP and this has to be done every 3 months. All i was told to send was a letter from my GP saying what was wrong with me medical history and also saying if i was able to work and my GP did all that said i was not fit for any work also sent lots of hospital information and note all medication. And was sent special delivery But over a week still not got it. so what has upset me is i was not told the right information i have always done everything right in the past and never had this problem ever i just feel thay are messing me around far to much and now my money will be even more delayed because this woman i been talking to has said if i send in all the right paper work for my GP my money will start right away. I want to put in a complaint but worried if this will go against me. And may make things worse i am just so worried i got bills to pay food to get and i got no money coming in i have told them this but dont seem to care at all. I will now wait till next week see my GP again and get all the paper work i have to get i have a fax no and my Gp sec will send it i also have the persons name who to send it to so then it cannot get lost and if this happenes again i will go to the office if it kills me to walk there and put it on there desk myself.Thanks again for all you have helped me with will let you know how i get on.0

The 3 month sicknote sounds like more misinformation you seem to have received. Sicknotes can be for any duration but obviously they need to cover you continually.
I'm still not entirely sure you have actually written a letter of appeal or filled in GL24... but just to confirm, what they've asked you to send in otherwise would not constitute that...i.e. hospital reports, sicknote etc. So please ensure you have appealed... last thing you need is to run out of time for that. And make sure your appeal is targetting of the descriptors. What i cannot seem to get my head around is theses sick notes yes i understand i have to send one with the appeal but then was told i have to send one every 3 months or every 6 months she was not sure how offten. But i also looked on the web page and it said if you are not ever to be fit for work you would be left alone unless my condition changed in anyway. But was told no i have to send sick nots still. Why i just dont know? I just feel i have been messed around so much. So for the second time i will send all the right infor i have been told to send yet again and see what happenes this time round. Thnks again and sorry to be such a pain it is just i get told one thing that is wrong so fingers crossed all is right now .0

Once you have been officially found 'not fit for work' and granted ESA you will not have to send further sicknotes. At the moment you are classed as being fit for work so your GP needs to certify that you are not.
You don't have to send a note very 3 months, my last one was for 6 months. You do have to make sure that your sicknotes run continuously to make sure there is no break in payments.
With ESA no-one will ever be classed as permanently unfit, even people in the support group will face regular reassessment.0 -
Personally I think dying is probably the best option for me as I can't see my way through this maze of injusticeNot entirely true is it?
If you happen to die in between reassessments, there isn't an awful lot they can do!
I have my face-to-face assessment next Tuesday & reading these threads know I have no chance even though I have been through & failed 3 previous IB assessments
A brief look at my history is 2 strokes & 2 heart attacks with 3 stents 2 of which no longer work, along with the possibility of a new wrist joint due to a fall I had during an angina attack all within the last 12 yrs.
This all seems very minor compared to the comments on here but don't see how I could possibly sign up for JSA which implies I am fit to work 40hrs a week & therefore calling myself a liar all these years
Along with the medical problems I no longer go out alone nor do I trust my Dr to support me in this, my surgery are all about money & I can't afford to pay for the Drs reports (the appointment no. is 0844)
I feel completely alone with this even though I have a full time working, loving & supportive husband & feel he would be so much better off without me & all this added stress but he says lets just jump each hoop as it comes along
So I guess I will be back here asking questions & seeing how you guys are getting along very soon...good luck all who pass this way0 -
OH had his Atos medical today - first time that he's felt like they were trying purposefully to trip him up - all the other times have been fine.
So not sure what to think now - guess we'll see when the results are in - the assessor seemed more concerned that we don't have a social life as all his questions seemed to based on what we do as a couple - how often we go out - what we do at home - it was all very odd - am left scratching my head a bit to be honest!
For the record we don't have much of a social life - but surely that's our choice?..lol0 -

Yeah the questions can be apparently indirect to obtain apparent facts to justify ruling out descriptors. What you do at home for example could shed light on many of the descriptor groups... as do things like hobbies or what you do with other people. Questions like do you watch TV and what do you watch they could use to determine if you can sit comfortably for periods and concentrate... I daren't imagine what descriptors 'having sex with the missus' would rule out but probably all of them as far as they're concerned..lol. They like to extrapolate to such a degree it beggars belief sometimes. The 'trying to trip you up' is definitely what I felt and I think it is because of the indirect questioning which is quite unlike what you'd expect at the cop shop if facing less serious charges..lol.
You could request a copy of the report resulting from the medical by the ATOS HCP... call number at top of DWP ESA letters and request copy of it (ESA85). This document obviously isn't the result of the (WCA) assessment but it should give a firm indication of what decision may be reached or at least save a trip to the library fiction section."Do not attribute to conspiracy what can adequately be explained by incompetence" - rogerblack0 -

Regarding the sicknotes they must continually cover you.. so their duration can be anything... supplying a monthly one every month is fine for example. The sicknotes enable qualification during assessment phase (for new claims) and during period of appealing against decision to deny you ESA.
As for being left alone... unlikely... regular reassessment is going to apply to almost all cases.
Just make sure you have indicated to them you request to appeal their decision
