It was quite hard to convince the phone operative 'you'll get a copy of the decision'.
The key is to make them understand that you want a copy of the report _before_ the decisionmaker gets to it, as you believe there may be errors.0 -

I've found the solution to getting them to make sense is to drink half a bottle of vodka before dialling..lol. I couldn't convince the agent there was such a thing as an ESA85A in my last call."Do not attribute to conspiracy what can adequately be explained by incompetence" - rogerblack0 -
I been to see my Gp this week and told her the DWP lost the reports she sent so asked her for them again and to ask if my Gp could fax them over so it wont get lost again. Got a phone call from DWP Tuesday afternoon to let me know the sick note for 3 months and a letter and some hospital reports, was told she would pass them on and should get my money by the end of this week. Looked at my bank today and saw the moeny had gone in:j. What i want to ask i only got £135.00 that is £67.50 per week it said on my bank statement £135.00 LESA DWP. Am i right thinking we dont get the full incapacity payment till the appeal is over with. Don't want to ring them to ask beause all i seem to get is jargon i really dont unerstand. So if anyone can answer my question that would be helpfull.

Yes, basic rate ESA while appealing after failing WCA. If you successfully appeal then they'll backdate any additional monies owed."Do not attribute to conspiracy what can adequately be explained by incompetence" - rogerblack0 -
Got my letter confirming that I would be getting ESA at the assessment rate this morning. Like you drmqn442 it will be £135 every two weeks, so unfortunately I will be approx £30 a week down until my appeal is heard:(0

On the plus side - the medical report arrived today, only 6 days after it happened, and 3 days after I phoned.
I've glanced at the cover, and it's mine, but I can't face it at the moment, and am going back to bed for a bit.
Need to digest it over the weekend, and send an amended copy in on monday, along with any last-minute arguments that spring to mind when going over my claim pack.0 -
Glad you got your report back i have asked a few times for mine and still not got it:mad: Fed up asking them for it. May ask again for the last time i know one thing about all the new rules the DWP dont make it easy for us. we are all genuwin people with health problems. Dont't you think we have enough to cope with? i know i have everyday is a effort for me just to get out of bed. I am sure we all would love to gety back into work i know i would do anything to work again my problems i have now was not even my fault well half of it was not the Hospital caused most of it and has now left me this way and even the Hospital have admitted it. So i guess we all have to fight for what we need. I now one thing if my appeal is turned down again after my GP has told them i am not fit of any work i will take it to my MP as he has helped me so many times in the passed when i had to fight for DLA that took a few times but then i got it indefinite and i know that is hard to get would you not think i have DLA these people would think i do need this also the mind boggles some times.0

Glad you got your report back i have asked a few times for mine and still not got it.
If you need a report non-urgently, then you can make a request for it under the data protection act.

Well surprise surprise, the DWP were as good as there word and my money has gone in as promised, thought I would have had to chase them.0

Well here I am again...Applied for ESA85 report on Monday & it arrived this morning
Basically on page 6 of 7 it says "client was found to meet support group criteria" & ends with "client is unlikely to return to work & undertake work related activity in the longer term"
Obviously I know this could all be changed by DWP but as I read it I assume I will be placed in the support group & assuming this is the case I'd like to know what happens next?0
