    Is the 15 point thing both for physical and mental health? I remember with the Incapacity medical it was something like 10pts for physical and then 15 for physical and mental or something like that.

  • I failed my atos medical for ESA despite passing it everytime over the last 4 years, this year I got 0 even though things are no better. One thing is anxiety, because I wasn't rocking in the medical they said I wasn't anxious!!!

    I have lodged an appeal and now my money is at the assessment rate for god knows how long and I have to send a sick note in every 4 months.

    To qualify for the 'lower' of the two ESA main phase groups (WRAG) you need 15 points or more and they can be combined from physical and/or mental descriptors.

    If she appeals ESA and supplies continual sicknotes then should be able to get assessment rate ESA while awaiting appeal. I'd contact local authority to get HB/CTB reinstated (due to low income or due to ESA reinstatement at assessment rate)

    Right I have been to the CAB today but I am a little confused:o The adviser I saw does not usually deal with this type of query, but she has filled all their forms in plus my appeal form, and this will now go to one of their advisers that specialises in this area. She has told me take the appeal form into the job centre and tell them I am appealing, but also to ring the DWP and advise them that I am appealing with the aid of CAB. I thought I had to send the appeal form back to the DWP office, that is dealing with my case along with a Dr`s note to say I am unfit to work. Could someone please clarify for me, what is the correct procedure about sending the appeal form and Dr`s note to the DWP? Many thanks to anyone who takes the time to advise me on what to do.

    I note they still are using language likely to cause the media to run bad press against the claimaints

    ^ that leads to claims they were 'faking' it and closed the claim or had the claim clsoed due to being a faker.

    Instead of reporting that those are mainly people with short term injuries/illness that recovered before the date for assessment.

    They were warned before about stats being misused - and have no excuse for continuing to release such a diabolically worded press release - they obviously want the propaganda to continue, hence ignoring the previous warnings.

    I would post in the appeal to the dwp (keep a copy!) and make sure its sent recorded or special delivery.

    Also ring them to say you are appealing.

    After checking online they have received the form, wait a few days then ring them again to ensure they really have got your appeal....

    ps also do the same for the dr's fit note - keep copies, post in recorded, confirm by phone.

    There is no reason why you should not hilite a factual error, although I would be cautious with your language, however, you need to differentiate fact from opinion, in the case of the latter you cannot simply take an opposite position, you need to show that the opinion is either not based on facts presented or is erroneous.


    If the 'opinion' in the report differs from your evidence that you presented - then the sasessor MUST explain why their opinnion is valid - and yours is not.

    They do not do that - hence are in breach of contract/legislation and ethical bodies rules.

    So report them.
