    Thanks for your response - it is of course your prerogative to "not get into this" . Note, however, that I *asked* about your own behaviour rather than stating what it was and that's because it can be as relevant as the behaviour of the Ts.

    I was interested that you should query "does the fact they are non-uk residents have any affect on their rights?" over on LLZ . You now presumably know that the same LL& T laws apply to them as to any other T in Eng/Wales ( & ditto criminal law if they have committed a crime)

    I hope your daughter achieves an early re-occupancy with support from a locksmith and attending TRO and/or police officer and that you manage to reach a suitable resolve via the appropriate service of notices/court order. As posted before, take up your complaint, about the Ts apparent threats,directly with the police, in writing.

    i APPRECIATE all the responses and advise i have received but some comments have been quite harsh, like 'why u posting here' and saying that i have been threatening to the TENANTS? reallyyyy?? how am i suppose to react, and to be honest i think i have been quite reserved.

    i was under the impression this was an open forum where i could ask for advise regardless if i have seen a solicitor or posted in a another forum, someone may have gone through something similar and offer some insight..i guess i got it wrong!

    Having thought about this a bit, I believe your daughter should make a complaint to the housing department that she has been locked out of her home, it is their responsibility to then sort out the persons responsible. You should continue to pursue the police for the threatening behaviour.

    Can you honestly tell us that you did nothing to precipitate the situation? I am not being judgmental but it does seem very strange behaviour to just blow up like this.

    The only thing i did was ask for the 3 months rent and told both if they didnt pay they would be evicted as i can't allow them to stay in my house rent free..was i wrong in doing so??

    I think what you are getting wrong is that you are using 2 open forums to give selected parts of the story, rather than the whole issue. Now, you might think that the aspects you are asking about are separate. Hopefully, you will begin to see that all aspects of this problem have a bearing on both your 'separate' problems. And as an open forum you should not be surprised if people ask relevant searching problems, even if you don't avail yourself of the openness to relay all of the relevant issues

    No, I can't say it was wrong, but it sort of depends on how you told them, if you were angry and showed it then they may well have become angry in return. It's always best to deal with tenants in a respectful manner, even if they are being idiots. A S21 or S8 would have got your meaning over just as well, they probably do not understand the law any better than you do. Or should I say did, you probably have a lot more idea now.

    Threats to cause criminal damage which includes arson is a criminal offence. Yes she can be arrested and I have done so in past.

    Threats -Sec 2 Criminal Damage Act 1971

    Section 2 provides that a person threatening another, with the intent that the other would fear the threat would be carried out
    (a) to destroy or damage any property belonging to that other or a third person; or(b) to destroy or damage his own property in a way which he knows is likely to endanger the life of that other or a third person;shall be guilty of an offence.

    Proofing it may be difficult though.



    Report it to the police, it is not a civil matter, they fogged you off. If they don't take it seriously speak to their sergeant. Get it recorded.
