    If you want her out, them may I suggest going straight to the s21. (if the contract allows)
    The problem with a s8, is that it at the judges discretion whether to evict on this or not. If the tenants can make a valid plea for paying the arrears a judge will rarely evict.

    Not sure how it works in England and Wales tbh but in Scotland rent arrears is a gamble if you really want them out.

    Please also seek professional help if you are at all unsure of the procedure, one silly mistake in the paperwork and it will all be thrown out, this can take months to rectify.

    I would press the Police, take the day off present myself at the local station and refuse to leave unless seen by a senior officer.

    And if they quibbled I'd call the local paper-

    "House tenant threatens - buy me out or I burn it -Police told me -Not interested- £$*& off-"

    always sells and embarrasses the heck out of them!

    Examine your landlords insurance documentation very carefully indeed. This tenant is very unlikely indeed to go through with their empty threats. If they are in rent-arrears then the possibility of them finding alternative accommodation are slim, so why damage the roof over your head which you have already? It's just daft.

    If you need any help whatsoever about taking the correct and formal steps to evict this horrible tenant, just say the word. There are a fair few experienced landlords on this site who may be able to advise you. Alternatively the LandlordZone forum may be useful to you as well.

    A word of advice: from now on please do not contact your tenant by any means whatsoever other than IN WRITING. No phone calls. Nothing. You need to do everything you can to avoid being accused of harassment. Screen all your phone calls from now on and accept none from your tenant.

    Do you have legal cover on your Landlord's insurance policy, I've absolutley no doubt that when you explain to them what's happening they'll be very keen to get it resolved very quickly indeed?

    In which case you should have a read of Sue's thread about her most unsatisfactory tenant as well as an extremely unsatisfactory agent, to put it mildly. But luckily Sue's tenant is absconding or has absconded rather than threatening to burn the place down.

    Hmm!! If the insurer is told of the tenant's threats, you may find they withdraw cover!!! It is a horrible situation.

    I have one rule, even if you get a void, avoid dole scroungers, less income is better than less income plus expenses.

    1.The OP has not yet said whether the T is in fact in receipt of JSA/other benefits.

    2. Describing those who are claiming unemployment benefit as"scroungers" suggest you are an ignoramus Daily Mail reader.

    Many benefit claimants have personally previously paid into the system and not all claimants are rent dodgers

    Would they be allowed to do that, surely the point of Landlord's insurance is to safeguard against such malicious damage?
