Can I return this tablet

Hiya,

I bought a Blackberry playbook today, as they where reduced. We were told it had all the features etc and it could load Android apps.

We got it home and ok, you can web surf, but it has no calender, no in built email client, very few apps, no native email app, no skype. No android apps till the new version, coming in Feb.

Basically it's a huge bag of fail and was misrepresented.

Am I within my rights to just take it back as it is about as much use as a chocolate tea pot?

    just wondering which tablet it is cos ive been thinking about buying one from currys for 169.99 which was originally 399.99

    Yep, This is one of these from Currys. The size is nice, the feeling is nice, but unless you only want to surf the web, its pretty much useless. They even charge £5 to install angry birds!

    If I had paid £400 for it, I would be even more livid!

    Just to add, for some, lack of things like calender may be acceptable, but I live by my calender and email. It is basically a glorified web browser in a box.

    there is a beta android market available but the official launch has been delayed
    have a google search for it
    when you get it on, you should be able to add most of what you want

    I did do, but for example the calender and email don't work after being imported. Basically to me, its no use whatsoever as its missing all the critical stuff

    We have these at work. They're designed to be used with a BlackBerry. Your calendar and email are synched from your BlackBerry.

    It seems to me that the item is not as described and not fit for purpose. So, I would imagine you are within your rights to return it. However, that may not be the easiest thing to achieve with Currys.

    Perhaps so, but if you ask 'Does this have features such as calendar, email etc.?' and the sales assistant says 'Yes', then you have redress under the SOGA should it turn out to be not the case.

    The issue here will be the interpretation of 'misrepresented' and probably come down to the OP's word against the sales assistant (or someone representing the sales assistant).

    Did they? It is one thing if misrepresentations have been made as to a product's capabilities. But as far as I am aware there is no general active duty on a retailer to inform customers of product features. Whilst the wording of the Sale of Goods Act is thrown around repeatedly in this forum, it should not be forgotten that the customer has responsibility in the first instance to ensure that they are buying the correct product, and are buying a product that is suitable for their own needs.

    Now I am by no means an expert on the Blackberry Playbook. But the details in the OP very much read like a consumer has bought a disappointing product, and not one that is inherently unfit for purpose. The crux of the matter lies in what the sales assistant actually said in relation to it having 'all the features' and that it could 'load Android Apps'. If misrepresentations have been made in that regard, then the OP may have a case. If not, the OP is going to struggle.
