katieoneill wrote: »Hello, I hope someone can help me with this to ease the worry. My partner has held insurance for our home for just under 2 years, through a broker, underwritten by Lloyds. Six months ago we hada substantial fire at our property and in December 2011, we were granted indemnity (insurer confirmed we were covered). The insurance hadn't been in touch since January 2012 and we were getting very worried at the lack of info, especially since they had stopped paying us interim payments for alternative accomodation rent. At the weekend we received a letter from their solicitors stating my partner had relevant convictions and our insurance was being avoided. They found this out in January and left us with no info until now.
His conviction was for criminal damage when he was 17. He was convicted when he was 18 and received 3 months Young Offenders suspended for 12 months. We assumed this conviction was spent after 3 years according to yourrights.org. This was 7 years ago, he is now 25.
What are our rights? Should the insurance companies solicitors not have recognised these as spent?
I'd appreciate any help!

I just smashed the inside of my plasma moving it, the damage is the internal glass is smashed and thats it, the casing and everything else seems ok(but tv wont turn on)
I really would prefer it fixed since its a model not available in the shops or even if they offer a replacement it would be hard to find.0 -
I can only agree with comments posted about price not being the only factor here - reputation is key.
My mum (a lady in her mid 70's) recently had a bad experience with her insurance company when her toilet leaked over time and drenched the floor under the bathroom lino. Repair needed the bathroom to be gutted and rebuilt (and other rooms repaired) but I was astounded when her insurance company tried to settle the claim by simply sending her a cheque for £300. Luckily I had independently obtained my own quote for repair of £3000 so was very clear that the settlement would fall well short of the value of the claim. I cant help thinking that the insurance company were acting unethically towards my mum. ie taking advantage of the fact that my mum was unlikely to know the value of the claim and trying to settle it quickly / well under its value / at no risk of additional work being identified
I would urge anyone in a similar position to return the cheque and tell the insurance company to organise the repair themselves.0 -
eecar is a deceitful untrustworthy company who are presently under investigation by the Metropolitan Police. If youhave had problems with them call Consumer Direct tel: 08454 040 506 (ask them to call you back if you do not like 0845 numbers they will call you right back) they will take all details and have the Trading Standards call you within 7-days. Also remember these scumbags also have ebike evan ehouse elet do the reviews on all those sites too just put "insurance review after each!!!!0

Absolutely fuming!!!!!
Right. Yesterday I spent 5 hours of my life trying to reduce the cost of my 'Buildings and Contents' insurance.
I am livid!!!!!!!!
Tried them all from Go compare to Moneysupermarket.
Also went on Quidco and got a cashback code.
Cheapest quote was Swinton @ 9.99p/m. I then get a phone call from Swinton telling me that they can reduce the price to 8.79p/m.
"Excellent, can I have the quote reference number please"?
I'll do a bit more research then phone tomorrow.
Quidco are offering a code for £30 cashback with Swinton.
Today I have gone on to the Swinton website and entered the code. (family fortunes noise). I then phone them and they tell me that the quote reference was phone only, not web!!!! Excuse me.
They then give me a new quote with an extra tenner because of administration. They will not honour the existing quote.
Right so I go back to Moneysupermarket and get a new quote but it will not allow me to enter the cashback code.
So in conclusion over 5 hours work and I have saved just 7 pounds.
Less than minimum wage.
Brilliant......................................... .not!!!! Thanks Martin for all the advice!0 -

According to this: http://www.unlock.org.uk/userfiles/file/unlockinginsurance/UNLOCKInsuranceGuideSimple.pdf
and this http://www.unlock.org.uk/userfiles/file/unlockinginsurance/UNLOCKInsuranceGuideDetailed.pdf it would take 7 years to be spent. It would have been halved if he was under 18 when convicted. It seems odd to use the date of conviction and not the date of the offence, but I have checked the law here http://www.legislation.gov.uk/ukpga/1974/53 and it's correct.
So you need to check the dates carefully to see whether it was spent when the relevant insurance policy started; that will help decide your next step.We need the earth for food, water, and shelter.

I would check what question the insurer asks regarding convictions. The reason being, because alot ask for ay convictions in the last 5yrs
Most insurance forms state have you ever been convicted if spent under the rehabilitation of offenders act it does not have to be disclosed.
Note online insurers do not in general cover any cases where there has been a criminal Conviction.
I'd recommend calling Dave Burn of TRYoungs on 0191 645 2011 as he has schemes for them and properties which have problems with subsidence and claims0 -
