Just had a car crash...

    I'll admit i've not read the full thread.
    But I worked in insurance, and they class indicators as exactly that. It's no guarantee and as such you should not have advanced, indicator or not, untilly the other driver had completed their manouver *sp*.
    Chances are you will be held to fault, not 50/50.

    :D Utter rubbish, it's not going to end up being 100% the OP's fault when it was the other driver performing the manoeuvre. The OP isn't a mind reader and didn't know they were going to do what they did. When you say you worked in insurance what did you do, make the coffee?

    That may be so, but it doesn't matter what you know or think, all that matters is what you can PROVE in court. Without evidence or witnesses, only conflicting statements of the OP and the other driver, it will likely go 50/50.

    You should be prepared to a reasonable level for other vehicles around you to make unexpected manoeuvres (eg sudden braking for something in the road) this is the whole point of safe following distance etc, however I think it's unreasonable to expect the OP to assume that a car pulling up on the right hand side of the road is going to suddenly turn left without indicating. She should have checked her mirrors and indicated, she clearly did neither. It is obviously her fault, but he cannot prove she was not indicating so like I say I reckon it'll go knock for knock.

    This one shows the main impact on my car. As you can see, just by the door hinge, which shows it was more her coming into the side of me. Do you agree?

    Looks like it. I don't know why she didn't look in her rear view mirror either. Surely she would've seen you. Despite me having my indicator on i've had people not stopping behind me and i've had to stop across the road from my drive until they pass.
  • She went that slow that it looked like she had parked up on he right hand side of the road completely.

    My difficulty is proving it. So frustrating that I could potentially have to pay out for something that is not my fault. I can guarantee that even the most cautious driver would have done the same as me in that situation. Wish I had video recording :(

    Did you take pictures of the road set up too? That will go in your favour, at least the car is still driveable, if the panels are not dented, it looks like it will polish out.

    Will take pics asap but here is the road entrance and roughly the crash place. She went far right as if parking on the right hand side. Then decides to go into drive on the left.
