Just had a car crash...

  • Although some people should be fined for using them. On my way to work in the mornings I go down the A57

I approach from the left and cars coming from the right will indicate right to go straight on. There's no left turn for them to tell people they're passing.

Why would you be against something that would make the road safer?
I don't believe it would make the roads safer, I also believe it would be misused by the police as another money making opportunity against the general public, much like the "unsafe lane change" tickets are in the US.
  • for future reference get yourself on ebay, for 26 quid you can get a camera that you fit up by your rear view mirror and run a cable round to your fag lighter, it starts recording when you start the car, stops a minute after you stop the engine and overwrites the oldest footage. no doubts or he said she said when it comes to insurance claims.
  • Sounds like you were following her too closely and going to fast for a housing estate, she may have been wrong not to indicate but you must also have been partly to blame or you should have been able to stop in time and avoid the collision. I'd say 50/50 some cars have a large turning circle to get around a 90 degree angle which I'm guessing is the case here.

Nothing worse than driving down the motorway and someone pulls out without indicating, has to possibility to cause a crash.
    Because it's a ridiculous idea.
10 MPh speed limits everywhere would make the roads safer. I'm against the idea though.
  • To be honest, it is difficult to say on the forum evidence and not being there etc etc.

My first thought is this might go as your fault being a bit hasty on the undertake. 1st rule of the road, assume everyone is an idiot!

Certainly I think insurance might go that way esp if the other person says they just slowed down and swung wide to drive into a driveway.

    It's a difficult call however.
  • So the loss of two years' NCB and higher premiums because of an at fault claim (doesn't matter whether 1% or 100% your fault). Quite a bill over the next 5 years.

I think a New Year gift to myself will be permanent in car video to some humongous permanent HD drive.

Non signaling is the biggest problem i see on the road now, it should be made a £60 fine.

Indicators do NOT give you right of way!
On or not, you should only make the manoeuvre if it is safe to do so!

    .
    Rule 103

Signals warn and inform other road users, including pedestrians (see 'Signals to other road users'), of your intended actions. You should always
    • give clear signals in plenty of time, having checked it is not misleading to signal at that time
    • use them to advise other road users before changing course or direction, stopping or moving off
    • cancel them after use
    • make sure your signals will not confuse others. If, for instance, you want to stop after a side road, do not signal until you are passing the road. If you signal earlier it may give the impression that you intend to turn into the road. Your brake lights will warn traffic behind you that you are slowing down
    • use an arm signal to emphasise or reinforce your signal if necessary.
    • Remember that signalling does not give you priority

And before the pedantics get involved with "the HC is not a legal book", remember from the introduction:-

"Although failure to comply with the other rules of the Code will not, in itself, cause a person to be prosecuted, The Highway Code may be used in evidence in any court proceedings under the Traffic Acts (see 'The road user and the law') to establish liability. This includes rules which use advisory wording such as ‘should/should not’ or ‘do/do not’."

Here is roughly what happened in a gif that I made.

    http://i42.tinypic.com/30jkxec.gif

She goes over to the right and looks like she is parking up there so I advance.

She doesn't signal and turns left back into my path in my lane of the road to go into the driveway on the left. Bang.

If I thought there was even a chance she was doing anything other than parking on the right, I obviously wouldn't have advanced.

My friend think insurance will take easy option and go 50/50 even though it is 100% her fault.

Sadly as you were travelling in a forward motion and was aware of the potential hazard, you maybe the one deemed at 100% fault, you proceeded even though it was hazardous to do so, what you thought the 3rd party intended to do and what they actually did do were different, a slight inconvenience to avoid an accident was the best method to adopt.

How can you say the OP was driving too close? They clearly stated that they were intending to drive past the other car which had pulled over to the right.

FYI, I've nearly had two bumps this week, neither my fault:
    1. I was going around a roundabout and a driver pulled out of an exit alongside me and cut right across the front of me so I had to hit the brakes so hard the ABS kicked in.
    2. I was turning right at a roundabout in the left of two lanes marked right turn, and the driver next to me in the rightmost lane cut across me into the left lane of the exit. Again I had to brake hard.
