Patronising buyer wants refund but will not return item

Please can someone help here:

Mid Jan i sold a PS2 game on ebay. I do state in my listings that i may take a few days to dispatch the item as i have to travel to town for the Post Office. TWO days after the listing ended i started recieving hassleing emails that they had not recieved the item :eek: , what do they expect?.

Once they did recieve the item they apparently sent me an email moaning about the postage cost on the envelope was significantly different to what i had charged. I charged £1.99 for 1st class P&P - i believe the envelope stated 80p. I did not recieve this email but he sent another a few days later stating the item was faulty (no chance) and again about the P&P and how i didnt reply(?!?).

I replied stating that P&P means Postage AND PACKING costs. I use padded Jiffy envelopes that i buy individually from the post office - these can vary in price (usually between 40-70/80p). I also have to travel to the town in order to post the items ( one way bus fare is £2 - i also have a baby in tow) - this all costs money right? He also agreed with the P&P costs before bidding on my item, so why the problem!!! So am i really being unfair? I mean i HAVE NEVER EVER had a complaint before and i have a score of over 300 (100% positive might i add).

Now the thing that is really getting me is that this guy is saying the game is faulty and he has apparently taken it to Game (the retailer) and they have said the game has been produced with errors - there is absolutely no way this could be true as the game was bought as a fully checked pre-owned game from the same retailer and it has been played over and over perfectly fine and as with all my items they are checked through before i list them. Also they have had the game for a while now - about 2 weeks.

As he stated it is faulty i politely asked him to send me the game back so i can have a look and i will happily refund him straight away. He is not accepting this and is stating that i must refund him before he sends it back - no chance, i dont reckon i will even see the item again - i think this is part of his plan. he has a slight reputation of moaning about high P&P costs and also being patronising in feedback to others.

Feedback doesnt bother me - it is the fact he is demanding a refund first and has even put in a claim to paypal. What do you think i can do?

(sorry for my rant - he has really bothered me)

    What an obnoxious buyer.
    If he has put a claim via Paypal hold tight - they will insist he sends it back to you first before you have to give him a refund.
    He may also need to send documents that prove the game is indeed faulty before they rule in his favour.

    Do nothing until you get the game back.

    If you were being exceptionally generous, you could give him one last chance, telling him you'll need to receive the game back so that you can check the security markings, first to identify that it's the right game, and also so that you can take up the problem with your supplier.

  • You're right in what you have done. The buyer needs to send the item back before a refund should be issued. If the buyer started a PayPal dispute they would tell them exactly the same thing.

  • Thats what i was hoping would happen but i know that paypal have a tendancy to rule in the buyers favour. Hopefully you are right. they are quite patronising and im woried that my wording is not as great and he may win through being nasty. However im sure i will continue to recieve nasty emails from this horid person. I will note the request for the item first and then i will issue a refund again in the dispute. That way hopefully they will see that i am complying with their rules.

    you don't have to do anything right now until paypal rule on the situation. they will make him send it back and they wont make you pay him for the return postage either!

    ie, do not refund until you have the item back in hand

    Also if you really want to wind him up (and if it was me i would) if he doesnt send the item via recorded delivery you could always say you never got it. Horrid yes, but hey so has he been
  • make sure you keep all the emails he has sent you and vice versa, that way if it does get into a dispute you can forward them to ebay
    finally debt free and want to keep it that way!!
  • Does anyone know, is it possible to "blacklist" this sort of buyer so you don't have to do business with them again? I've had 2 crappy buyers and I'd hate them to pop up again in future sales...probably extremely unlikely that they would?

    you can add them to your blocked bidders list. i think its in your personal settings or search for it under help in ebay

    I had a similar situation, buyer wanted a refund but didn't want to send it back, it was escalated to a dispute, I agreed to refund on receipt of returned goods, the buyer really shot themselves in the foot, had they waited they would have got a refund.

    I got a neutral but it hasn't affected my rating, still got 100% and you can write your side of the story on the feedback follow up.
