Buyer opened dispute on faulty item.

Hi guys, I've got a problem. I've sold old car radio on ebay. I stated in item condition and description as faulty, no return. I couldn't connect radio to my car and that's why I described it as faulty. Radio had some defect to the screen (I think thats are dead pixels) showed on picture, but buyer claims he thought that was dust and photos were editted (he put that in negative feedback). Radio also had opened fascia, but I didn't know if it's broken or not, cos I couldn't conect it to source of power. I didn't wrote anything about that in description, only stated radio is faulty. Now buyer opened dispute and want full refund, because radio doesn't work. What to do now? Do I have any chance in this dispute?

I would think you have no hope of success and would strongly recommend you offer a full refund on return of the item. You don't want the claim closing against you as you'll get a strike on your seller dashboard if it does.

Dont put no returns, Seems to be attracting troublesome buyers lately.

Buyers can return items by filing a dispute against you, Get too many and you wont be able to sell.

  • I don't know about this one, I think a polite yet firm telephone call to eBay might be worth a try, as it said quite clearly in the listing it was faulty

Depends on the actual wording i guess. Said dead pixels. But maybe it has another defect?

That's why I think it best to refund. If buyer claims the fault is in addition to anything you have stated is faulty he will win.

Mobile phone auctions often suffer with this problem- a seller will state something like 'faulty screen' buy for spares or repair and will lose a case if it turns out the battery is also shot or the casing is badly scratched- if the auction doesn;t state that. I have sold damaged mobile phones in the past and as I could not be sure exactly how much was affected have always sold it as a worst case scenario- ie for spares only- this phone doesn't work and I can see a screen crack but also think there are other internal issues. Probably not suitable for repairs but for spares only. Then i get glowing feedback saying how a £20 screen repair fixed it and they have a lovely phone, but rather that than a SNAD claim. (strangely enough I often get more money than other phones being sold as merely faulty and for easy repair)

I know you have not sold a phone but the same applies- if you mentioned only a couple of faults and it turns out to be something different then buyer can easily appeal and win.

Thanks guys for replies. I thought I can sell faulty items without any problems from buyers. I so many times received item not as described was happy and never opened dispute, especially when i was buying faulty items. I'll wait for a few day and offer full refund. That's shame sellers have less rights than buyers :(

If you read my post you will see that it is quite possible to sell faulty goods, I have not said anywhere at all that it is not possible.

Buyer probably thought it was a simple fix and he could sell-on as working item for £. Now he's stumped, wants money back. I'd let him raise a SNAD & contest it via resolution centre
  • i got ripped off in the summer when i sold a dead netbook. i clearly stated in the title and the description that it was faulty but the buyer filed a claim and got not only a full refund but never returned the item!
You got to get through what you've got to go through to get what you want but you got to know what you want to get through what you got to go through.

So when you appealed what did paypal say about the non return?

Unless buyer can show that an attempted delivery was made or that seller refused to sign for a return he cannot have won.
