What are my rights as a customer

I am after a little advice on what rights a customer has if an item was purchased less than 12 months ago and has now failed.

This is the story:

My Dad who is getting on a little and knows nothing about computers (hence the reason I am on here asking the question) purchase a pay as you go mobile phone from phones 4 u.

He has had it less than 12 months and the phone would not switch on, having taken it back to phones 4 u and them sending it away he was told on its return that the phones battery had gone wrong and was knackered.

He asked what they were going to do about this and the reply was you will need to pay £76 yes that’s right £76 for a new battery, the phone is a Samsung although not quite sure im of the model (it is not a touch screen phone or anything fancy).

Now I personally cannot believe that they expect him to pay £76 for a new battery and I am sure that he must be well within his statutory rights to either ask them to supply a new battery free of charge or a new phone.

They (Phones 4 u) seem to have washed there hands of it and I get a little fed up of these companies being nice when your purchasing a product from them and then dropping you when they have you money.

I would like to know what if any rights my Dad has and what can be done about this.

    The handset should have a 12m warranty, but unfortunately the battery is classed as a consumable and is not covered by the warranty.
    Suggest you shop around for a much cheaper battery-it should not be that much-try an independent phone shop.
    No free lunch, and no free laptop ;)

    Or Ebay or a market. At least check prices on Ebay first.

    find out what model it is and look it up online should only cost about a fiver i should think

    watch out for cheap batteries - tend to be useless in my experience.

    You could try your luck at a Carphone warehouse store. They may repair it for you free of charge, even if it wasn't purchased through them. Take in a receipt with the IMEI number of the phone on it, your dad's address, name and date of purchase and they will book it in. I've never known them to charge for a battery replacement before. No guarantees though! Don't tell them that Samsung want you to pay for the battery, just take it in as you would have done originally if that makes sense?

    Batteries can last less than 12 months especially if they are not used correctly e.g. constantly leaving on charge.
    IT Consultant in the utilities industry specialising in the retail electricity market.

    4 Credit Card and 1 Loan PPI claims settled for £26k, 1 rejected (Opus).
  • Carphone won't do it, batteries have a six month warranty with them as well.

    You need to buy a new battery.
