write to them and ask them to remove your address from their database if you are still concerned.

Dear Collegues,

I saw the advertisement of 'Financial Claim UK' for 'Refund Charges' on Money Saving Expert.com about 1 year ago. I asked FCUK to deal with my banks and credit card files in April 2007 and I sent them about 48 claims (1 third for banks and 2 third for credit cards).

From that time, I am phoning them every week, once a week to know at which state my files are. I even know the name of two people in this FCUK firm that I am contacting every single week for near one year and I am hearing all the time the same answer:
We have your files but we cannot discuss your claim over the phone but a manager will phone you and will write to you within one week! Till today I never received any reply from them, not even one letter!!![

<O:p</O:pNormally, their policy states that they should answer and complete any file within 3 months of reception. But till today I have received nothing from them!!!!

I even asked to cancel my file many times but they refuse to do so and ask me to pay them £125 per file (around £6,000)!!!
<O:p</O:p

Today, after 11 months, I feel hopeless and powerless with this company! I cannot know at what level are my files or if they are really doing something about it. Actually, they could have pocket the money of the refund charges that I would not even know about it!!!
<O:p</O:p

So, I am coming here not only to complain about this company but mainly to warn all of you about it. Do not deal with them!!!

And, if you have any advise or solution for my case, please let me know as soon as possible?
<O:p</O:p

Thanking you in advance
<O:p</O:p

Hi Luc.

I had the exact same problem.

I want to cancel with them and just do it myself, although I am now concerned that the banks have been given another 6 months before having to deal with new complaints.

I am going to write a letter requesting them to stop acting on my behalf, and that I will lodge a new complaint in 14 days.

Does anyone know good "legal speak" that basically states that I am now acting on my own and that the banks should ignore any previous claims?

Thanks guys!
• Hi

I have recently, out of frustration accepted an offer from a PPI reclaiming company because I was getting no reply from Barclaycard about PPI insurance being mis-sold.

The thing is, I have followed your instructions and after 2 days of receiving a letter from the reclaiming company I received a settlement letter from Barclaycard reffering to MY letter that I sent them in July. I am going to accept the offer as I am in the red and currently on a Debt Management Program.

My question is this, the 14 day period has passed to cancel and in their "contract" it states that if I cancel I have to pay them £500 or pay 25% plus VAT for any payouts.

I have 2 more claims that they are handling, one that got nowhere with Santander and a Barclays Loan claim.

I only received the letter from the claiming company 2 days ago saying that they have sent in the paperwork for my claims and that I should NOT accept any claims but refer any offers to them. I feel with this claim though that the final settlement response was because of the groundwork I did because the banks offer letter refers to my final letter (before complaining to the FOS).

I am going to accept anyway because of the reasons above. How legally binding are these contracts with claiming companies.

Also in their letter it states: "We have now submitted a detailed report to Barclaycard and will contact you as soon as we hear from them. Please note that PPI claims are taking three to four months to complete on average." So I doubt that they can claim that they were responsible for the claim being succesfull after only 7 days.

Please can anybody give me advise on where I stand and where I stand legally if they want to claim their 25% for this claim.

I know..... I should have been more patient, but I am in a financial mess and got no reply from the bank. Please help.

Kind Regards,
Papapax

 RECLAIM 2 GAIN..dont have anything to do with these!!!..they have a very clever way of wording their calls...they scammed my son out of around £65..hes never had any loans or credit cards..they made out they were from his bank and would be putting £60 into his account because it was owed to him..they knew allsorts about him..and he thought it was a genuine call (being only a young lad)they asked him for his bank details so they could get the money back for him and to put it in his account..theyd need this. they spoke very quickly and confidantly..they said theyd send him the details in the post the next day..it was also almost £5 for p+p recorded delivery...this letter did come..it was a template letter for PPI claiming...and a note saying they had took nearly £65 out of his account...he can not afford this...but what can he do?? cant prove anything i dont suppose?except warn other people? ...its an expensive lesson in scams for a young lad i suppose..at least hes learnt..

Hi There

I would suggest that you put in a formal complaint to the Ministry of Justice. Write to the company and ask them to refund the money.

I disagree completely, and contest that this is a geniue posting. In my opinon the company symmetric systems t/a bank-smart are dodgy. They tried to take me to court for disputing their cancellation fee after I cancelled their service

They lost their argument against me after their claim was dismissed by the judge because their terms where ambigous and badly written and there was no case to justify their fee.

They claim to do work for 10 % on a no win no fee basis this is set out in their terms of engagement letter but their terms and conditions where clearly different. It clearly stated if you claim falls within a certain value they will see a minimum fee of £150+VAT. When I refused to pay they added £50.00 for a debt collection fee (which wasnt included in their claim) and when it was going to court add on £150 for a processing fee. The court case reference was 8QZ17000 and was held in Croydon County court on 16th March 09.

I would strongly advise that you avoid this company and do it yourself. I intend to obtain the judge's decision in writing and post on here for all to see.

Also it is important to note that on their website they claim to be dealing with £100,000,000 of claims. I find that hard to believe when the company hasn't filed any returns for 2 years due to being a small company they are exempt and has an acid ratio of .83 also they have no phone no in which you contact them.

Avoid, Avoid Avoid

Hello , Just out of curiousity what is acid ratio .83??

Thanks

You'll be lucky to get an answer from that poster.

This thread is 2 years old, and the poster who only made 8 posts in total made their final visit here only a few days later ;)

A family member took out a bank card and ran up debt to roughly the sum of £1.500 which she was paying £40 a month to clear this and the bank says she still owed some £1,350 - even though she has been paying this £40 for quite a while - anyway the main point
A guy appeared at her door with the perfect solution - or so he convinced her - he worked for a company called Lawnet UK Scotland and he said that the bank were wrong in getting her to pay so much back and he could get the bank to lower/reduce/cancel some of the interest she was paying or words to that effect and off he went with her £100 lighter in her purse - 5 months passed nothing so she called his business number and he said that her case had been filed but had not been put on the computer and he would action it that day - he also said her case was being passed to a sister company BANK SMART to deal with - she then gets a letter confirming BANK SMART are looking at her delema in April 2011 through email she gets a bill from BANK SMART saying that she owes them £138.00 on their bill saying Claim assessment complete - that they had sent a letter to the bank requesting a copy of executed agreement - and that they sent a letter to the bank confirming they are in breach of the Consumer Credit Act and requesting a copy of agreement within 14 days - and later they comment Claim Assessment complete - these notes range a timeline from Nov 2010 to March 2011 - BANK SMARTS bill states Feb 2011 Statement/Agreement Overdue £10 and costs (UCA) overdue £94.80 = £104.80 and the heading of the email says she owes £134.80 - they also say that none of their people visit doors and collect cash - and I will give them that because the guy was from Lawnet.

She has never received any reductions or repayments from the bank and if she had she believed that the initial £100 she paid would possibly cover the "The claims experts" costs

Now she still owes the £1,350 to the bank and BANK SMART are after more money from her - she had kept this debt away from the rest of the family and it has only came to light and I am asking where does she stand as far as paying BANK SMART - as she does not know where to turn - it is bad enough owing the bank without finding out she has another group chasing her for cash

Any advice would be welcome

There's no golden bullet to get out of repaying the money she borrowed. She owes what she owes. She needs to dig deep and repay what she borrowed.

She should also look into any liabilities she exposed herself to when she agreed to a further contract with whoever, in her attempt to avoid repaying what she owes.

If there was a way to avoid repaying our debts, we'd all be on it ... and no one would ever lend if they knew there was no way to enforce repayment.
