Step 1 : send DPA letter to get list of charges (10 mins and a stamp)
Step 2: Add the charges up (maybe an hour)
Step 3: Post first letter (10 mins)
Step 4: 14 days later post 2nd letter. (10 mins)
Depending which bank it is natwest/rbs you'll get a cheque then
else step 5: enter court claim (online - an hour max) so 2.5 hours - your claim is 2k plus of which 25% is £500 ! nice hourly rate if you can get it
step 6: wait for your money
Yes that does sound easy but in Scotland the small claims limit is £750 and the next step up is Summary Cause at £1500. With 2 claims above this amount I have to raise an Ordinary Action which requires a lawyer and in Scotland we can't us MCOL either. So it is much trickier up here and I'm seriously considering getting someone to help me out. I am at the staage of sending my second LBA.0 -
Scotland I would recommend using the FOS....or claiming from an England address is possible through the english courts system. I wouldnt recommend splitting claims in scotland as I know Edingburgh court at least won't accept subsequent claims.
How much is your claim for ?
Govan Law Centre may be a good site to look at for some tips.LegalBeagles0 -
Thanks for that.:A
LTSB £5084   (current account)
CB £2970.50   (closed business account)
Someone on CAG advised to still split the claim for LLoyds and go down the FOS route for CB as they are resisting split claims but I think it will be safer to do this for both.
The claim for Lloyds only goes back 4 years as this was all I had online and I wanted to get a move on. I have applied for my charges predating this and the intention is that my husband will reclaim these under his name when we find out how much they are.
Edilass has just given me the link for FOS. Why couldn't I find that?0 -
yes I think you are right to do that for both of them...the FOS seem okay in Scotland and get interest too, but maybe a little slower than court claiming.Edilass has just given me the link for FOS. Why couldn't I find that?
you forgot theres internet outside MSE ??LegalBeagles0 -

I have a client who wants to claim back charges on his business account. The volume of transactions means that he simply does not want to do this himself. Has anybody used one of these companies themselves, or know of anybody who has?
Thanks in advance0 -
That'll be within an Accountant's remit I should think. There aren't any specific companies setup just for this issue.0

There are companies out there who are charging extortionate rates for claiming charges back for you, however if he would like to make a small donation to comic relief i'm sure i could help out0
