So what can i do if the worst happens and i refund the buyer. the item is returned and i find that the stone has been swapped or the item has been damaged. Obviously i file a report with e-bay but am i just left having been messed about and out of pocket?0

Can you ask them to send you detailed pictures of the prongs that they are not happy with? Might give you a better idea of what is going on.

If the stone has been swapped, then you contact the Police.
If the ring has been damaged, check your house contents insurance.
You WILL lose this dispute, so you might as well just accept it and arrange for the buyer to return the ring OR agree the £100 discount.British Ex-pat in British Columbia!0 -
I'd ask for the written confirmation from the jeweller who is going to do the repair & say that you'll pay them direct. If it's a chancer then they may drop it.0

Thanks hermum i have done exactly that. Asked for a written quote from the jewelers for the repairs that need doing and i have also asked for a report from this person who looked at the diamond and said that there are all these other problems with it. I have also asked for pictures of the ring to show the problem with the prongs.
I still have the pictures of the ring from before i sent it off so i will be able to tell if something has happened to it since it's been in her care.0 -
well well well. This is how the story ends. After lining up a second buyer for the item. I asked the buyer to send the item back and once i received it and checked it was in the same condition as i sent it out then i would issue a refund....
This is the message i got back...
Buyer's message:
"Hi there, i just remebered one thing i need to let you know, that before finding out the problem with the prongs i already got the ring resized to a J as i thought i would definitely keep it for my wedding, but unfortunately soon i just realised the prongs issue, what a shame! well, just like i told you i would surely keep it if the prongs're in right placement! But no big worries, the resizing has been done seamlessly and professionally so there's no any mark left that you can see from the shank. All the gold marks inside the ring are still at the same place too. i can take and show you some pictures of the shank/band this weekend if you wana see it and confirm it. Beside the size, the ring is just as same condition as when it was with you, i didn't even get it professionaly cleaned yet as thought would do it right before the wedding day! Anyway, you can give it a thoroughly check when you get it later. Regard."
The ring was a size o/p so now i cant even sell it to my second buyer.
I have spoken to e-bay and the case is due for escalation today. By god am i escalating this case.
I would hope based on this information i should now win this no contest...0 -

I would be on the phone to ebay about this. I would have thought that a jeweller would have told her that the prongs were out before resizing, in case she blamed them for damaging it.
I cannot see how ebay can find in her favour after removing a chunk of gold from it.0 -
yea, get on the blower to ebay. i've found that phoning them (and paypal) gets better results than emailing or just using the dispute centre.helpful tips
