Buyer seems to be getting quite nasty now and unfortunately if you let eBay or Paypal resolve it they will find in the buyers favour. Their decision will be to tell the buyer to return the ring for a refund, which Paypal will then request you redeposit the money to bring your account back into good standing.
The problem with this is in theory the buyer could send you back absolutely anything and so long as it is tracked and they can prove attempted delivery they will get their refund.It may sometimes seem like I can't spell, I can, I just can't type0 -
My dealings with ebay and paypal in a similar type of case I sold a set of expensive headlights for a BMW after 2 weeks the buyer complained that the item was broken and could not be used as the adjusters would not work as the mounts had snapped off, there was nothing wrong at all with this lights and I refuted the claim vigorously, anyway end of story was I was forced by paypal to refund money and the item was returned to me that's when the penny dropped the lights where not the original ones I sold and they had obviously been switched with another faulty set. All this I argued with ebay and paypal that I had been duped to no avail they never even answered . I no longer sell anything on ebay of any value because of this as they will ALWAYS side with the buyer whatever...:mad:0

what i'm arguing with e-bay is that the item i sold was a diamond ring. As i said i was honest about the details. I'm not a dealer in jewelry and it was my engagement ring. The buyer is now saying that two of the prongs holding the stone are slightly closer than the others. My argument is that the buyer had detailed photos of the item prior to purchase.
Personally I think they need the cash back instead of the ring or have tried to sell it on and found no one buying at the moment.
you say the buyer had more detailed photos of the item, but how does ebay know this.
you should always use the ebay message service to communicate, this wahy ebay have a track record of communicatiosn. photos could of been sent using a URL ( you upload to rapidshare etc. and then just give the buyer the url links to the photos.) also did the detailed photos show the prongs close up0 -
I haver informed e-bay that i sent more detailed photos and that i am willing to forward these for them look at as part of the case. and yes the pictures do show the prongs up very close and personal.0

"That is really ridiculous about all the excuses you made!Indeed it is a tough time now for everyone and that's why i don't mind to buy a second hand diamond ring on ebay for my wedding rather than buying a new one in stores, i understand you need the money for your baby but you cannot cheat people for it like this! it's not easy to make money for anybody! i don't mind to spend such big amount money on a wedding ring if it has good condition and especially knew it's already cheaper than those new in stores, but there's something really fishy about your ring and it is really not as right as you showed and described in your listing and email! i was bit wondering that since you've already taken such nice pictures of the ring, why didn't you just simply add them on the listing to attract more bidders?! Thats how I understand it at least. The jewlellers wont touch it as its gonna damage the prongs, therefore the diamond couldnt have been moved/changed by you as the prongs would have been damaged. Buyer's saying they are bent, with no sign the diamond has been moved previously
either way, if the pictures show proof, upload them to the dispute - have you tried calling ebay? Not that I'm convinced they will be able to assist any better.
also, have you asked for a quote from the jewlellers yourself? How much is the repair going to actually cost as if she's able to provide the jewellers information for you to confirm the quote is legit then at least you can rule out that the buyer's not being dishonest.
Either way, your best bet is to offer a partial refund as suggested already - £50 is a better loss than the full £800 surely. Otherwise, you'll have to accept a return for full refund. Sadly, the best you could hope for in that situation is that the buyer doesnt return it trackable as only with proof of return (tracking frmo the buyer) can ebay/paypal force you to refund.0 -
Not sure why this matters in this case, they are still regulated by the FSA. As far as I can tell from this case they haven't done anything wrong, if the buyer was on here asking for advice having been sold an expensive item that they said had a fault we'd be advising them to sort it via Paypal. Short of checking every item that is sold there is no way Ebay or Paypal can know who is telling the truth in a case like this. As they are providing services in the UK the FSA and FOS may have some jurisdiction but I think overall it may come down their local regulator. Check with the FOS to see if they will accept complaints or not. If not they should hopefully be able to tell you who will.
As for moving forward, at this stage it is unlikely Ebay have even looked at any messages they just let the buyer and seller get on with it until they need to. If a claim gets escalated it may take another few weeks to get anywhere.
I might try asking the buyer if they could take it to an independent jeweller to verify the details and any costs for repair that you would cover..0 -
Well, I'd say that implying the buyer is a con artist via the dispute centre isn't hugely helpful, regardless of the provocation. I can't see any outcome other than buyer being told to return by tracked method for a refund. Although ignorant, she doesn't sound like scammer.0
