The only way a CCJ would be registered against somebody is if they fail to pay whatever the judge orders within 28 days. A loss in the county court does not automatically mean CCJ or damage to credit rating.
I doubt if Parking Eye would go anywhere near a court when a judge has now ruled that the only money they can claim for is the actual material loss suffered and not some arbitrary penalty.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
Thank you both for the reassurance re the CCJ. That's good to know.
They still insist on asking for £60 in their letter though, increasing to £120 after the deadline, rather than what I have since discovered was a £10 charge for staying over 2 hours. You would think if they had learnt from the ruling, they would start by asking for £10, which they are more likely to get more people paying, rather than £60 and being ignored yet spending more money on admin sending out more demands.
I trust the advice remains consistent ie ignore everything they send and don't offer £10 even?0 -

It is believed the judge erred in awarding the costs of parking and associated costs against Smithy because Parking Eye made no attempt to recover the parking charges that Smithy hadn't paid. Instead they went straight for the penalty which the judge decided was an unfair penalty."You should know not to believe everything in media & polls by now !"

Thanks Trebor16. I've just read some of the other threads by you and CRBlogger, suggesting that the person should offer to pay the £4 parking charge because they failed to buy a ticket. Do I understand correctly that that doesn't apply to my situation as the first 2 hrs were free, even though, unbeknown to me, you were supposed to buy a ticket at a flat rate of £10 if you were staying longer?
I had wondered if offering £10 would get them off my back and stop further nasty letters?0 -

The offer of paying them their legitimate parking charge did occur to me initially, but having thought about it they always try and claim their penalty charge and make no effort to ask for the outstanding parking charge only. With that in mind I wouldn't offer them anything and would just carry on ignoring them."You should know not to believe everything in media & polls by now !"
