You can open a Co-Op Cashminder before you go BR, so I'd get on to that soonest and then notify benefits of the new bank details. Have any sole benefits paid into that account and then joint benefits into your partner's perhaps.

You don't need to worry about obtaining copy credit agreements, all provable debts prior to petitioning BR are included in the action. You could apply for your Statutory Credit Reports from all three agencies if you don't have records of all debt in the home. All your debts should be included across the 3 reports. Do apply for the paper copies though as some members have reported the online versions aren't as good.

  • Just an update for those interested- Had an appointment with the debt advisor at CAB today, she suggests Bankruptcy for me and a DRO for my partner. I was feeling a little better knowing there was a way out this nightmare, but then told the fees, eek!!! I find it so ironic how you can charge £500-700+ for someone in such a situation. I don't know how but will find this money asap. My partner suggested using the drips and draps left on credit cards, but I'm sure this will be frowned upon. She said if i had the money tomorrow it would be completed by christmas..wow!! Wouldn't that be a great christmas present (in a weird sorta way). Are there any organisations that can help with these fees, properly not and who could blame them. She then told me after being made bankrupt an OR (Hey learning the slang) will conduct an interview, whats peoples experiences of these interviews, what happens? what is asked???
    Many thanks Paul.

I believe some have resorted to using cards in the past to pay the BR fees - not sure if they do cash withdrawls on them first or not. It's not ideal though.
Generally it's through saving/cutting back/notpaying unsecured debts/ selling stuff etc to get the money.
Oh and you do get a small fee remission I believe as you are on benefits.

You will get the fee remission on the court fees, do will have to find the £500.

If you look at the sticky marked Look Here First: Bankruptcy Help... you will find links to the EX160 form and examples on how to fill it in. There is also a link to the turn2us website to look at grants etc. you never know something may turn up.There is also links to other sources of help. Stop paying all debts and just pay essential bills. You can use what is left on credit cards. It's not ideal but the OR will understand. You would need to take the money in cash and keep it to one side and not spend it on anything else, do it before you stop paying them. Sell things, scrimp and save. Go to the CAB and see if there are any local bursaries that can help, we have a couple in our area.

Paul please use the dribs and drabs from credit cards as your partner suggests and do not pay any of your creditors who you are going to include in the bankruptcy in the meantime, your OR will understand this. x
