It wasn't so much flaming him as asking to tone it down abit from the grief that everyone was joining with an opinion on the increase.
Thanks for the link,
While ofcom are saying that as a group it's not a breach so they won't investigate, feel free to do their job for them and do it by yourself...... I guess they want to stick to doing surveys.
All I posted was what was realistic, and still to be honest I feel that most if not all of you knew that the outcome would be in favour of the company.
Sorry it has not worked out for the 'hopeful majority' but that is the economy at the present.0 -
DUTR, There's still some fight in this, but as stated above It is a hole below the waterline.....
It does seem like Ofcom is just a industry mouthpiece now, like most regulators.
One advantage is that as Ofcom aren't looking into wether it is fair or not is that my response from Orange has to come from a director
A little wiser, and a whole lot more annoyed too. Guess Ofcom really wanted to finish early for Xmas then0 -

Just to say that the response didn't come from a director it came from someone in their office known more commonly as a secretary who files through all of the emails and then forwards the important ones on to the directors themselves. It is very unlikely that it came from the director or that they had any say in what went in the email as I got a standard email from the executive office saying that it was something the company could no long sustain and that it was a business decision and that I couldn't exit penalty free. I have requested a sim to transfer my number onto pay and go.
Fine by me if i cant ext penalty free I have gone over to Vodafone with my new contract saying that nothing will be increased and that I pay that set price no matter if they increase prices.0 -
Well it has reached the table office for Parliamentary Questions.
The following has been asked:
To ask the Secretary of State for Culture, Media and Sport whether the jurisdiction of the Ofcom approved Communications and Internet Services Adjudication Scheme (CISAS) extends to complaints about telecom price rises and, if not, why not.
how many representations a) he has had and b) Ofcom has had about the recent Orange Mobile price rise.
what research his Department or Ofcom has conducted on consumer awareness of the terms and conditions of telecoms contracts, including the provision to increase prices before the end of the contract period.
what conclusion Ofcom has reached as to whether the Orange Mobile price rise is fair to its existing customers already under contract.
Although I suspect Ofcom have answered the last part already.
Still I doubt it will make any difference for those wishing to bail out without penalty.0 -

Do you have a link to this? Or have you emailed you MP to look into it?0 -
Hi all, we have been in contact with Ofcom in an attempt to get some clarity on the action those of you affected by this rise can take. They have sent us the following statement:
Ofcom has considered the complaints it has received about the recent rise in Orange’s prices and acknowledges that many consumers feel unhappy with these changes.
However, having assessed the complaints against the relevant consumer legislation, Ofcom has decided, on the evidence available, not to proceed with an investigation at this time as this price rise is not likely to be a breach of current legislation.
Whilst we do not believe that there is a case for us to investigate this general matter, whether or not individual consumers suffer material detriment will depend on the individual circumstances in each case, and customers can still contact Orange if they think they have or will suffer material detriment and be prepared to provide evidence to support their claim. Further, where a customer has concerns that Orange has not met its terms and conditions the relevant dispute resolution body, CISAS, may be able to consider this.
Which means that whether Orange like it or not, individual customers can still establish material detriment on their particular circumstances - and cancel the contract without penalty.
For example - financial hardship. Or, if you're doing a cashback deal, it may be that the increase will amount to a material increase on the net amount you'd expected to pay. Many cashback deals effectively cost little or nothing over 24 months - this increase will give rise to a huge % increase on that.0 -
isn't financial hardship and material detriment 2 different things though?
No answer from OFT or legal team yet.0 -
Sorry didn't explain why my answer needs to come from a director. I specifically asked if He (Mr Swantee) felt the term as it was and where it was hidden or not. And in the context of a consumer NOT being told at point of sale that it existed wether he felt it was unfair and maybe not as prominent as it should be under UTCCR.
Now as Ofcom have said they won't investigate at all it falls to a director to respond under UTCCR
I'll edit when I'm on a my pc to link to the terms0 -

Ok sorry wasnt meaning to pick holes in what you had said but know you have stated that it makes your post more understandable.0 -
Fixed Contract Term should equal Fixed Contract Price.
The Futures Bright Without Orange......
I will vote with my feet at end of contract EVEN if it costs more elsewhere.
It's a matter of principal !!!0
