    I have also had a letter telling me that my card company rejected my £149 payment. The card company say that they have not turned back any payment. Had a long and fruitess conversation with Littlewoods cs in which she did finally get me the note that said it was priced wrongly, but insisted that I had had my payment refused. I wonmder if it was because I wa a bit later ordering and they cancelled the payment but an automatic letter got sent out? I'm going to contact the card company again as although there is no cash changed hands it really anoys me that they are weaslling out by saying my card was turned down when it wasn't.

    This remains one of the more interesting posts on the thread as it indicates explicitly during a 'live' order (rather than only being extrapolated from T&Cs) that, as far as Littlewoods were concerned, the particular order had reached the Despatch stage; was therefore an Accepted order and by their own definition had therefore formed a contract proven by their charging a card for the money. The particular wording mentioned in that linked thread doesn't appear on my order (via Debit Card) and I would be very keen to know if a member on here could verify that it did in fact appear for Credit Card orders in the Transaction History on the Littlewoods website, preferably with a screenshot. Anybody ?

  • Saying that the contract is only formed once they dispatch the goods seems like unfair terms to me. Its like they're saying 'there is no contract until we fulfill the contract'. So contractually they never have to fulfill any order and could take the money and run if they wanted to.

    If the laptop had arrived, then the tranaction would have been complete. The delivery of the goods is obviously a significant part of the transaction.

    Even a written contract can be voided if it was known there was a mistake.

    It may be worth making a claim, they may decide to settle rather than fight it - it's even possible that you might win, but it certainly isn't an open and shut case at all.
    I am usually pretty cynical, and don't like Littlewoods marketing practices, but I hardly think that they went to the trouble of mixing up descriptions and product codes just so that they could take orders that they weren't going to fulfill. It's hardly good PR, is it?

    BTW, my refund appeared in the bank today.

    Have you (or anyone else interested in the point we are discussing) looked in the "Transaction History" section of their account? Don't look in the "Track Order" section. Log in; click on "my account"; Click on 4th item in the menu - "Transaction history". It brings up what is headed for me as "Last Statement 1".

    I understand from your post that you paid by debit card. Did they take payment? What does it say in your transaction history?

    Just to clarify for you tony, and anyone else, this isn't a case of order status saying 'in despatch stage'. My, and I presume most other peoples transaction history says that payment was taken on despatch. They are therefore explicitly confirming, that, as payment has been taken, the 'despatch' commenced. It may have been recalled after despatch, but that is not relevant.

    Ah, somebody's been reading the Ladybird book of contract law. I bet Littlewoods are quaking in their boots now!
    The facts are:
    The laptop was an obvious misprice
    It was posted here (and on HUKD) as such
    Everybody was told there was little chance of getting one
    Many people still tried to get one or many, even using discount codes of questionalble suitability
    As expected, orders were cancelled
    Nobody lost any money
    Nobody died

    If you complain to Trading Standards or Watchdog I hope they laugh you out the building. There are genuine injustices out there that these organisations are meant to combat. To squander their time because you couldn't blag a mispriced laptop is a hideous waste of already overworked resource.

    Maybe Littlewoods not being about to cancel peoples registrations is questionable!
    Taking money from credits cards before goods are despatched is also questionable as this shouldnt happen til the goods are despatched!
    For many years theres been the method that if you are given the incorrect change after a transaction then this could not be rectified so why shouldnt people want the same in reverse i.e. Littlewoods have made an error, taken monies so should now honour the deal!
