Dear Mr Kirwilliam,
Further to your recent order request for a Toshiba A100 Laptop
(catalogue
number PR427 or PR393), please be advised that there was a price error
on
our website and the price shown was incorrect. We are therefore
declining
your order request in accordance with clauses 2.2 and 3.2 of our terms
and
conditions, which can be viewed on the website help pages. The laptop
price has now been amended if you wish to order at the correct price.
Kind Regards

matto wrote:Littlewoods will rely on their terms and conditions to the effect that no contract is formed until the goods are despatched. The only way around this is to claim the term is unfair under the Unfair Terms and Conditions in Consumer Contracts legislation. This would undoubtedly require high court action as it is a grey area...
So if someone were to go to the Small Claims Track and cite that
1. An item was ordered
2. The order was error-checked and confirmed by Littlewoods
3. The order was "Accepted" according to online tracking
4. The item was fully paid for
5. Goods are in stock
What would happen ?matto wrote:...You would have to argue that a consumer has a right to know exactly when a contract is formed and it not be some arbitrary point in the future. The terms and conditions are after all meaningless until the contract is formed.
Do you know how ITT law might relate to this matter ?

I think in the small claims court Littlewoods would be able to rely on their terms and conditions. I don't see them being overturned in the small claims court unless there is a precedent.0

Case like this you never know what might happen.0

Surely it's relevant that should Littlewoods wish to stand behind their T&Cs, it can be shown that they didn't follow these themselves ?
The only "case like this" I know of was the Dell TV fiasco from Oct/Nov 2005. Dell capitulated. They agreed to supply, took money and then couldn't deliver. People recieved refunds plus the cost of an equivalent model of TV. Seem all too similar to this case except by their own admission, Littlewoods can supply the same model of laptop just not at the price agreed.0 -
PeteHerts wrote:I use a site called Money Saving Expert hosted by Martin Lewis and on 30/01/2007 was made aware of a Toshiba A100 laptop for £249.99 advertised by Littlewoods Catalogue. At that price i ordered two (one for me and one for a friend). I registered with Littleowoods and used a 10% discount for first time users to get a price of £448.20 for both machines. I used my credit card as payment. On 31/01/2007 i recieved a confimation e-mail from from Littlewoods saying i would be recieving '"A100" laptop with Microsoft Windows Vista Home Premium Edition PR3933*' with an estimated delivery date of 21/02/2007. I then checked my order history and found under the sundry items it said my order was not sent and a credit to my Visa credit card.
I am aware that alot of people have ordered these laptops and ones at a lower price of £149.99. Also LXDirect Catalogue were advertising offers like these.
I also have printouts of the pages from Littlewoods advertising this.
Im not sure what Watchdog can do but i have asked other users to inform you of their particular situation.
I hope to you can help.
Many thanks in advance.

I will not be complaining to Watchdog - as has been noted on this board, it was a clear mis price, and in the unlikely event that I get one for £249, I will count myself extremely fortunate. The one thing that has annoyed me is that Littlewoods retrospectively adjusted their order records, leading to my order confirmation printout saying 'Laptop' and their online tracking system saying Vista. This is heavy handed of them, to say the least - surely the cancellation e mail (which I am yet to receive) would be sufficient to get them off the hook.
Anyhow. the number of orders pretty much guaranteed that Littlewoods would pick up the error and cancel all orders. Incidentally, assuming the text of the message you sent to Watchdog is complete, I notice you didn't mention that you had actually ordered six laptops.0
