please could you explain your reasons as to why you think it is theft?

also - when Ts overcharge you for an item - or any other company for that matter - this would be counted as theft also...???

i think you are refering to 'obtaining goods by deception' which is a scetion in The Theft Act - therefore if you would like to refer to my previous post regarding other ways of Obtaining goods by deception - ...... may make you see things a little clearer..?

I don't "think" it's theft, it IS theft. You know the stickered barcode will be a higher price than the original so you remove it to obtain the goods at a lower price.Theft.

Most stores wouldn't prosecute but would march you off the premises and ban you and quite rightly so.

Re DTD , You are right, knowingly obtaining it could also be found to obtaining goods by deception, if it could be proven.

I think knowingly and with intent are the key words in these discussions. Errors and ommissions are not counted. HTH

I am not dishonest, but I am not always completely honest when it comes to shopping, obviously I don't shoplift but I have kept quiet when being over-refunded, I've noticed lots of people on here saying they've been given more DTD that they were entitled to and how many have spoken up? I'd be interested to know.....

I think selective honesty is more common than complete and total honesty i.e. I might not speak up if given too much money from the till but someone recently left a fiver change in a self-service till and I handed it in without hesitation because that money belongs to a person not a large corporation.

ooohhh...you dont shop in Notts do you?? Last week while I was at CS, a young lady came up to say someone had left a £5 note in the change part of the SS.....:)

Locarr was referring to the newbie who on all 3 of his posts mentioned tampering with barcodes to get the item cheaper.

Earlier I posted this as although my conscience told me this was wrong, I wanted to confirm the legal view of this:

    (Quote)
A quick google shows that tampering with labels is classed as retail theft:

    Retail Theft
"...Statute 3929(a) defines retail theft as the taking of any merchandise without paying the full retail value required. This can include actually removing merchandise from the store, changing or removing labels and price tags or tampering with security tags. Retail theft is graded in 3929(b) based on ..."

Don't do it guys. It ain't worth it.

    (Unquote)

This quote is not from UK law. This law quote is from Pensylvania.

The UKlaw is similar - but has other jurisdictions and implements attached to it.

The basic definaition of theft (according to UK Theft Act 1968 - i think it is off top of my head) is this -

    (1) A person is guilty of theft if he dishonestly appropriates property belonging to another, with the intention of permanently depriving the other of it; shall be construed accordingly.

    (2) It is immaterial whether the appropriation is made with a view to gain, or is made for the thief!s own benefit and gain.

There is more to it - but trying to remember it from a few years ago now... thats the jist of it anyway.

    Have you accepted ?
Yes. I only ordered from Next online because I couldn't get the jacket my daughter wanted, in her size locally.
I won't be using them again so thought a discount was better than a credit note.
They send the stuff out before they charge you for it!
Anyway I paid while I was on the phone and have checked my online banking and she has only charged me £63.00 instead of £71.99
My husband says he will leave me if I don't stop shopping......... God I will miss that man.
