New freedom of bill act making PPC tickets legally backed?

    A judge will look to see if the cause of action, in bringing any Small Claim, is lawful and justified. So in the case of a fake PCN there will be no mention of 'cancelling a ticket'.

    The judge would want to establish whether a fair, clear, read and understood contract existed which would allow PPCScammerUK to claim the money they are seeking, and whether it is lawful that they claim it from the person they have named.

    Same as now. The answer is almost always, NO. No contract, no reason to rule in favour of PPCScammerUK.

    Lets wait and see what happens! :T

    The gov need to make this work, so there will be changes to make this happen. The UK needs business, cowboys or not all is £. DFT and Home Office both agree!. It's in my minutes

    My posts were sarcastic. There are so many obvious PPC trolls on here it's laughable....sticking their oar in and trying to frighten people about this bill even though it's miles off. If they get enough people frightened about this in advance it will work for them because more people will just pay.

    There's three of them I can identify. Christ, they're even having arguments amongst themselves and telling us to ignore tickets to look convincing...but ignore when the big bad bill comes and unspeakable evils will happen.
    Why would they be going to all this trouble they might ask? Because it's their livelihood at stake and it doesn't take much to register a few accounts and pretend to be someone else. Seeing as forums like this are the main source of information on PPCs and their practises it's the least I'd expect.

    I know who to listen to and who to believe...and it's good that others are noticing them too...even if you're a bit out sometimes :-)

    The only thing I'm really worried about is newbies looking at this forum for advice, being scared by these trolling jokers and paying up.

    Some might be telling you to ignore tickets but their other posts and general tone give them away and their masks are slipping. It's all to do with making people believe these companies have some sort of authority....keep saying it enough times and you will believe it.

    Newcomers should ignore all these red herrings about keeper liability and (non) independent appeals procedures.

    A Parking ticket is a civil debt, and if a motorist refuses to pay it the PPC will first have to prove to a court they have the authority of the landowner, then they would have to show that the amount demanded was a reasonable estimate of losses and then that the registered keeper was actually the driver.

    In the future the keeper of the vehicle may be under a legal obligation to reveal the driver, as happens with speeding offences, but this does not change the fact that unlike speeding, it is a civil matter.

    I think everyone (apart from PPC trolls ) would agree that for the forseeable future the best advice is to ignore these invoices.
