Claim Advice Service/Simply Credit Claims - Scam letters

Please help im so confused after reading everyones comments i really dont know what to do. i went bankrupt in may 2009 i have been discharged and i have receieved a letter from Simply Credit Claims maybe i was stupid but after ringing them i believed that i could claim back they told me it had all gone to court and that people who has gone bankrupt can actually claim back there ppi now. After having a call back and the lady sent me the letters to fill in i did so and after many weeks i got a letter from my old bank saying they were paying me back just under 600 pounds i rang SCC they seemed pretty happy that the letter mentioned that i was going to recieve a cheque and not going to the OR and that 35% would mean i have to pay them 209 pounds when the money cleared in my account i have not paid them yet but i have recieved the money and it has cleared being a single mum of 3 children the money has come in very handy but im now scared i might have to pay this money back to the courts after reading this info from everyone and i really dont know what to do? do i still ring and pay SCC or ring someone else to tell them what has happened. I had afew companies on the list for ppi 2 wrote back to say i didnt have ppi with them 1 said i would of had 47.78 pounds but that went straight towards that debt and the above from my old bank.. please can someone tel me what to do please!!!!!0

You should ring your OR straight away, basically you have taken and spent money that belonged to the bankruptcy, perhaps because the amount is fairly low and you have been misled by the claims company they may not ask you to pay it back. But it will be far better for you if you tell the OR yourself rather than them finding out by themselves further down the line, and obviously dont spent any more of the moneyHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

If the PPI was taken out BEFORE the date of bankruptcy then you would owe the OR (official receiver) the money due to you. Re-read post #69
It gets worse. It is very possible that you would owe the full-amount of the PPI refund to the OR (the full £600) AND the fee to the claims management firm (thus leaving you £209 out-of-pocket).
Have you written proof from the claims management firm of what they said? You could use this in a small claims court to defend against any claim they make of you for the £209 if it got that far.
You certainly should discuss this with the OR within 21 days of the payment to you. I'm sorry about your situation.0 -
Basically they have me screwed dont they do you think i can refuse to pay them i will be going to citizen advice 1st thing tomorrow and call my OR cant believe this has happened what horrible people to do this..... too good to be true i should have known im absoulutly gutted..
Hello i have been to my local citizen advice she has advised me not to panic to much as i have been wrongly infromed and i have a letter clearly stating that "as a discharged bankrupt you are entitled to make a claim, but would advise that the claims process may take longer than a typical claim" i was clearly misguided by this company.. The lady rang my OR who wanted to know exactly when i took out the loan i have been advised to write a letter to the OR explaining everything and take things from there but he did not say whether i could or could not claim.. I will not be spending anymore of the money as advised. As a bankrupt i have oviously cleared me debts i make sure i pay eveything on time to build my credit back up i really dont need this situation hanging over me head.. I sugggest that you make a formal complaint (marked "formal Complaint" and sent recorded delivery) outlining what this company told you about claiming after bankruptcy.
Inform them that you will not be paying their fee.
If after their final response, or 8 weeks (which ever the shorter) then you can make a claim to the Financial Ombudsman Service.
That is what I would advise you to do, and anyone else in your situation.

Hi please read post 28 by Fermi, you need to report it to the OR, try not to worry as I am sure if you explain that you thought you had done nothing wrong I am sure they will help you to sort it out. You never know you might not owe them anything as what they appear to do is wrongIf you woke up this morning congratulations, you have another chance :j0 -

I have just spent the adt 20 minutes on the phone to 2 different people from the claim credit service they told me I could claim back £6350 from my mortgage provider for being sold the mortgage that gave them the biggest commission to my provider rather than the best for me, all I had to do was pay him £1351 from my credit card they are very convincing but I did not pay anyone else had them on the phone?0
