Scams are quicker and easier to set up and run away from if there's less (registration) paper trail... Quite possible an individual thinks they've seen a way to make a quick buck, but they aren't in it for the long haul like the repeat offender big boys.When I joined, I needed a name. John Brogan seems to be a mortgage broker in with another chap as well. Why would you put your residential address on letters though? surely that is asking for trouble or just naive?0 -

When I reported these to the MOJ I did get a call back and they seemed very interested in following it up, i have heard no more but was told they seem to have other businesses registered within the financial arena. PLEASE REPORT IT AS I DID IT APPEARS TO BE A SCAM (PAY YOUR FEE, OH DEAR YOU CAN'T HAVE THE MONEY IT HAS BEEN CLAIMED BY THE OR, YOU ARE LEFT OUT OF POCKET BY THE SUM OF WHATEVER THEY CHARGE!) I was told that as they deal with finance and are offering to reclaim ppi they should be aware that what they are offering is a scam and not at all honestIf you woke up this morning congratulations, you have another chance :j0

My husband is a discharged Bankrupt and also received one of these letters from this company, he gave them a call, (without telling me first) and they told him that they could claim back PPI on a loan he had way longer than 6 years ago!! When he told me this alarm bells rang....I dealt with every aspect of his BR as he is not really very good at that kind of thing with regards to research and paperwork, so I know very well that no claims such as this can be made outside the 6 year period. We entered into a heated argument as to the legitimacy of this company, he believed what they had told him! I am so glad I researched and read this thread, i can now prove to him that I, (yet again! lol) am correct!!
The company have since sent another letter including a copy of one of "the many letters that arrive at our offices daily confirming a win for one of our DISCHARGED BANKRUPT clients." The letter is headed with the Santander logo, and to quote a couple of the paragraphs it states, ...."Having considered your clients claim and reviewed our records we have decided to re-imburse the value of PPI premiums paid with interest. We would therefore like to offer a total refund of £3,281.37."
Then it goes on to state that a breakdown of the offer is enclosed, then it states,...."Our record states that you were subject to a Bankruptcy Order.
If this has been discharged the redress will be issued directly to you. However we will require you to forward a copy of your discharge certificate along with the signed acceptance form.
If you are still subject to the Bankruptcy Order, please ensure that full details of the official receiver, their reference, and address are provided when the signed acceptance form is returned, in order that the payment may be made to them accordingly."
Either side of the photocopied picture of the letter are speech bubbles with arrows to certain paragraphs, the first one stating "Confirms a successful claim has been made and that our client will be paid £3281.37"
The next speech bubble states, "Confirms our client was subject to a Bankruptcy Order"
Next one states, "Confirms if our client is a discharged Bankrupt - payment will be made direct"
And the last one states, Confirms if our client is NOT a discharged Bankrupt then payment will be made to the Official Receiver."
The literature also claims that....- Everyday of every week Simply Credit Claims successfully wins claims for people who have been discharged from bankruptcy.
- Claims can be made for any debts included in a bankruptcy that included PPI.
- Claims can also be made for any loans or credit cards paid off prior to bankruptcy.
- successful claims result in payments being made to the discharged bankrupt.
And indeed, right at the conclusion of each piece of literature in small writing it states, "simply Credit Claims 32 Wentworth Way Dinnington South Yorkshire S25 2SY. Simply Credit Claims are regulated by the Ministry of Justice under Registration No. CRM15562 in respect of regulated claims management activities, particulars of it's registration are recorded on the website www.claimsregulation.gov.uk.
with all this 'Black and white proof' It's ever likely to stir vulnerable discharged Bankrupts into following this through! What I'd like to know is, what happens if they do follow it up? Have people actually received payments via this company? I'd like to hear their stories if they have.
And since no one has had any come back from ministry of Justice nor the OFT, does this mean the company is actually legit?

Can you please send that letter on to the Insolvency Service, as they want evidence that this company is conning the IS out of refunds that should be going to them/creditors.
By coincidence, this email from the IS was forwarded to me today by someone who made enquiries.Thank you for your e-mail of 02 January 2012.
I note that contributors to the money saving forums web-site have contacted the Ministry of Justice regarding the unsolicited mail they have received from the company.
You are of course correct in what you say regarding the ability, or rather lack of it, of a former bankrupt to pursue claims for mis-selling, where the right to pursue the action has passed to their trustee in bankruptcy.
However, the letter, and indeed the information on the Simply PPI web-site, does not specifically refer to claims which would clearly be for the trustee in bankruptcy and not the individual to pursue.
I do note the speculation on the forum but this is not, at this stage, a matter in which The Insolvency Service can intervene without evidence that the firm is pursuing claims vested in trustees in bankruptcy without their knowledge or consent.
The correct bodies have been notified of possible breaches of authorisation and consumer protection by forum contributors. If you have any specific evidence of claims being improperly pursued I shall of course be pleased to pass the information to the appropriate trustees in bankruptcy.

No it doesn't.
See the above email from the Insolvency Service.
The evidence they cite from Santander is utterly worthless, as many PPI refund departments from the banks (Santander included) do not really understand the legal implications of a bankruptcy on the right of claims and who the money should be paid to.
That Santander have made a **** up and paid someone direct when they should not have, is neither here nor there and proves nothing.

If you like I suppose.
I was just thinking that the MoJ etc would also want to see it, which is why I suggested sending copies.
That way if anyone else ever wants sight of the originals, you would have them.
Up to you really.
