    sorry not updated with the date Im having difficulty finding that tennancy agreement..Im not 100 % sure I got a copy..but will continue to look.
    Sine then I had asked if I could pay to clear my arreas and asked them to contact housing benefit..

    Im sorry I was not online so did not know about the visit.
    I have changed the locks as my key broke in the lock as it was a double lock set up and was very stiff
    to turn,also Nick the gas engineer attempted to use his keys to get in
    when I had no idea he was coming and the gas safety check was only done a few months ago..
    so yes I have changed the locks as Im sure he/you would not like anyone letting themselves into your home
    when no reason or warning was given.
    I am being completly honest in that I have no had any letters come here so please check this out.

    Now in regards to the rent I would like you to contact ***** Council and ask them to pay the rent direct.. I
    have to be 2 months in arreas for this but Im willing to sign an agree to this and of course once this is done
    I will pay what is outstanding or set up a payment plan for this.
    Come November D**** has agreed to re-sign as guarantor for 12 months and hopefully
    after them 12 months with my rent being paid direct an my tops ups being in on time
    then I will no longer need him to re-sign.

    I will allow 6 monthly inspections and will contact the office if any repairs need doing
    I have been renting over 15yrs so I know how it works, the house will be updated
    if my tenancy continues so the landlord will when I leave have a property rentable straight away.

    Im not going to be around much in these holidays as my son is changing schools so
    my family are helping him de-stress so please can the inspection be in September.

    I am in receipt of your email.

    Your landlord has been advised that once again, we have been unable to gain access to complete a property visit and he is extremely concerned that you have changed the locks without contacting the office.

    The boiler is under warranty and needed to be service so this appointment was separate to your annual landlords gas certificate.

    We will not be contacting **** Council with regard to your housing benefit, this is your responsibility.

    I am afraid that your landlord is no longer prepared to tolerate the manner in which your tenancy is being conducted and has instructed our office to serve your Section 21 Notice. This will be hand delivered to the property by the end of today, Wednesday 25 July.

    If you require any further information please do not hesitate to contact our office.

    So since then council have wrote an said they will be paying direct to landlord.. now today I get a sec 8 notice which expires on 17th Sept
    I dont know what to do now as they have lost some of my money an wouldnt negotiate so I could clear any arreas.. any advice?

  • Who has "lost" some of your money? Do you have proof that you paid it? Just because it's not showing on their rent-statement does not mean that they have not received it. Check your bank-statements, double-check and then check again.

    How much rent do you currently owe? PLEASE be aware that if your Section 8 has been issued because you are in two rental-period's worth of arrears, you will also need to be in two rental-period's-worth of arrears on the court-date in order for the landlord to gain possession of the property. Possession will be automatic unless you can get those arrears down to less than two rental-periods (usually calendar months). Yet another issue is that your local Council will not accept you as homeless if your landlord gains possession under that Section 8, as they will consider being evicted for rent-arrears as having made yourself voluntarily homeless.

    Sell anything and everything you can to get those arrears down asap!

    Write to the EA and ask for a rent statement, two copies sent tomorrow with certificates of posting (those are free). Or post one through the door and photo yourslef and send the other with a cert of posting.

    What money do you think has not been paid to the EA?

    And note that two months in arrears means that if your rent day is 1st of the month and you do not pay August and do not pay on September 1, by Spetwember 2 you are two months in arrears.

    Do you have any welfare advice/tenancy advice people in your town who can help you with this face to face?

    And please stop e-mailing the EA. This does not have the same standing as written (pen and paper) communication.

  • No, offering to pay down the arrears counts for nothing when you are in receipt of a Section 8 Notice. Only the precise amount outstanding counts on the day when it gets to court.

    now that is tight also if you pay 99p more for a meal is it a better tasting meal than the £5 meal and what about drinks they cost £2-£3 each who pays for them or bring your own bottle, supermarket 2 litre bottle cheap coke 18 pence, every little helps

    Can you try to be a little more clear about what is happening? Did you pay in cash through the door without getting a receipt, by cheque or what? If you paid by cash and it has been stolen this should have been reported to the police.

    You can pay the arrears by installments regardless of whether they agree, do you have the landlord or letting agent's bank account to pay money into? If not send cheques by recorded delivery, keep a photocopy of each cheque as well as the recorded delivery slip.

    Be aware that you could be charged for any changes you have made to the property - locks, paint, flooring - if you did not get the written permission of the landlord or his agent.
