    Check the written contract terms you have with the EA - it may be you have only given them sole agency rights, and not sole selling rights. If you have, then you can sell to someone else not introduced by the EA, and have no
    liability to pay the EA any commission. As for buildings insurance - insurance companies insure a building for no more than the cost of re-building it.

    just got of the phone, the EA has spoke to my partner and told him MRX want 800 off for electrics he has told him no and the EA has given him 20 mins to decide wether he want it for 68 or not or were pulling out but he gave him a hard sell telling him hes getting a bargin and houses are going for 80 round the corner i hope to god this hasent made his mind up for him and i hope to god he comes back and says he wants the 800 off so we can pull out

    In your position I would simply withdraw from this transaction. From what you have said you are selling the property for at least £8k less than it is worth to a con man, supported by a clearly (although not provable) fraudulent EA.

    Get a new agent, put it back on for £78 to £80k, take no less than £75k. When the old agent waves his contract at you tell him that if he wants to pursue it you will report him to whichever EA bodies he belongs to, you will write to the local papers & you will report him to the police.

    i want to desperately believe me, but try telling that to my partner he is so stubborn. even if Mrx comes back and says he will buy for 68 i can just see him messing us around for another month and trying to do this again even though my partner has given him a deadline to exchange he wont exchange on the deadline or he'l try and pull another fast one and my partner who is really trying my patience now will give him yet another chance iv even tried to refuse to sign the new mortgage agreement to try and get out of it but he went mental and said hes not just spent the last 6 months going through all this to end up back at square one

    well hes had his twenty minutes he hasn't contacted EA but partner has now moved the bar and says all he now wants is there sol to give are sol some sort of confirmation that he is buying for 68 by the end of today. aaaaaarrrrrrrrrrrrrrrrrrrrrrr

    Do you have the agreement letter that you signed with the estate agency?

    Does it mention "sole selling rights" or "sole agency" - and for what period of time (only you seem to have been given the run around for long enough)?

    You are the one who will be paying the Estate Agents fees so you get to tell them what to do - and they have to do it.

    In your position I'd be sorely tempted to:

    Get two/three other agents to come round and give you an up-to-date valuation (see whether their figures are in the same ballpark).

    If property is currently off the market - get your EA to put it straight back on at more realistic price - ie £77,500 or so, and make sure that amended details are sent out and it's being advertised properly. They cannot refuse to do this. Make sure they put it in the local paper.

    Even if it's still supposedly 'on' the market, get a friend to make a general enquiry about properties in your area at about the price you are marketed at - be interesting to see whether your details will be included......

    If you want to be really sneaky, ask one of your friends to phone up the Agents and ask if it's possible to make an appointment to view your house - and see whether they actually try to arrange one.

    Maybe I'm being cynical - but I know there are agents like that out there (not, fortunately any that I've worked for, but you know they exist). It may be against the law, but only if they get caught - iyswim

    I'd still be prepared to cancel sale to Mr X, Mrs X if necessary. You don't even have to give a reason if you don't want to. I think they could probably work it out for themselves.......although if they think they might lose out to another buyer they might suddenly realise they don't have you over a barrel after all - so far all they've been doing is giving you stress you don't need.

    Above all, don't let them panic you into selling well below market value because you might lose the one you're after - you're more likely to lose it because your current buyer is mucking you about unnecessarily.

    lot has happened, sol has bin on to buyers sol they want it for 68 and want to exchange Monday. just had another investor round who said he'd match their offer and could complete quickly, got another investor coming on Monday at 3 to view. what to do, do we exchange and just get over it and move on they say completion would be feb 23rd. or tell them about the other offer and try and bump up the price but risk loosing them and maybe risk this other investor dumping on us.
  • Are all these "investors" coming through your EA. If so, sounds a little strange (in my limited experience). Aren't there ANY buy-to-occupy folk in your area?

    zipwen, i hope these other investors are not coming through this website. They're nearly as bad as Mr X if they are and it is also all the proof you need that your house is undervalued.

    We want someone to buy it for it's proper value :)
