Seriously, me asking for a refund is fraud? Think i'll just take it to the skip then!

they may repair or replace, but think of it, you are not the one who purchased this from Argos, so you have no contract with Argos.

you may have the receipt, but whats to say you did not see someone purchase this from Argos and then follow them and take the item from them and as Argos usually places the receipt in the bag, so you would have the receipt.

    this is just 1 senario

but as you NEVER paid Argos anything wy should they give you a refund. if its fault return it to the seller as it is them you haver the contract with.

it is suspicious that you seem to not want to return to the seller

If you have the receipt nobody will be the wiser.

If the tv is faulty then does it really matter who returns it???

Argos can give you a gift card failing having the original payment card.

With respect your scenario is so out. I live 400 miles from the person I bought it from so it's rather fanciful to suspect that I could have travelled down there, followed this person and mugged them for a £140 telly:mad:

    Jesus wept.

in this case if the OP takes or requests a refund as they are not the original purchaser then they have no contract with Argos even if they have the receipt this can be constude as fraud.

    Seriously!!

So if you buy someone a present and give them the receipt incase there's a problem and they have to take it back for whatever reason, is that fraud too??
  • I cant see there being a problem, when ive bought presents from argos and the go faulty i just give the reciept to the person and let them exchange the item.

The reality is - the tv has a fault - somebody would have to return it to the store so whether it is replaced or refunded, it makes no difference to the retailer who the original purchaser was.

getting a refund if you are not the purchased CAN BE consrude as fraud

    notice CAN BE

SOGA and DSR the contact is between the purchaser and retailer

this is exactly the same information you would get from CAB or TS

so if goods are faulty you return then to the seller

Most places will provide a gift reciept if the item is to be given to someone else - this transfers rights to the holder, I believe. At least, it did where I worked.

As for Argos - the system will check that the card is the same, it's a money-laundering check. Its the same reason they won't give you cash - buying something and returning it, faulty or not, can be a way of transferring money around.

You might be able to get a gift card, or a replacement TV, but speak to them and see what they say. If Argos aren't happy to help, then contact the seller.

Not sure if Argos is the same or not, but in every other store I've had a refund in the cashier just asks you to put your card in the chip and pin reader and enter your PIN to get the refund. As they don't need to touch your card, how do they know whether you've put in the same card that was used to buy it or not? Even if they ask to see it you *could* just say you've been issued with a new card which is why the numbers don't match.

ETA - having said that, in the case of the OP, Argos are under no obligation to refund to them as they were not the original purchaser.

where i work you have to check the cards last 4 digits against the one on the receipt, the new card argument would only work if the card you were trying to refund onto was issued after the purchase was made .more and more retailers don't use the chip/pin to refund it has to be a signature so they would have the card to hand to check the signature.

Why didn't the origional seller take it back to argos themselves for a refund if they only bought it 2wks ago? you get a 14 day money back guarantee there dont you?
