Returning TV to Argos (bought from 3rd party)

I bought a TV from someone online. They purchased it from Argos 2 weeks ago. I am having trouble getting one of the HDMI sockets to work so suspect it may be faulty.

Can I as the purchaser of it second hand take it back to the store for a refund or exchange? I know the original purchasers details will have been taken for TVL purposes but if I have the reciept then hopefully I can still return it?

    If you have the receipt then they don't need to know you are the second owner. If you don't have the receipt they are under no obligation to have any dealings with you.

    Depends if the first buyer bought it on a card, (if you want a refund that it) they will want to refund it onto the card used.

    A repair or an exchange shouldnt be a problem though.

    Check they have another one in stock. Maybe worth travelling a little bit and reserve online 1st just incase.

    If they want to refund you will be stuck.

    Not strictly true. Argos would have no real way of knowing which card was used to purchase the item. As long as it is refunded to any card, there shouldn't be much of an issue, in that respect.

    You bought a 2 week old telly? and didnt think there may be something suspicious?.
    Strictly thou guarantees are for the original purchaser only, not if the good are second hand, but you could try bluffing them that you are the original buyer.

    I wonder why the original purchaser didn't take it back if it was faulty? Could be that they didn't know. But if they did seems a bit suspicious to me, did they actually buy it?

    They will refund back to the original card not another one. They certainly wouldn't refund to card that has a different name on it from the original purchaser. And you wouldn't be entitled to a refund anyway as you didn't buy, but if you have the receipt they might provide warranty support, ie. offer you a repair or replacement.

    the last four digits of the card are recorded where i work so you have to present the same card.

    Not sure if Argos is the same or not, but in every other store I've had a refund in the cashier just asks you to put your card in the chip and pin reader and enter your PIN to get the refund. As they don't need to touch your card, how do they know whether you've put in the same card that was used to buy it or not? Even if they ask to see it you *could* just say you've been issued with a new card which is why the numbers don't match.

    ETA - having said that, in the case of the OP, Argos are under no obligation to refund to them as they were not the original purchaser.

    the system itself records the card details and a refund will only be refunded to the same card it was purchased from.

    in this case if the OP takes or requests a refund as they are not the original purchaser then they have no contract with Argos even if they have the receipt this can be constude as fraud.

    if its faulty your contract is with whoever you purchased it from, so contact them and return it to them.

    The seller supplied a receipt so there was no need for me to be suspicious about it. Had they not had the receipt I would not have touched it with a bargepoll.

    The original purchaser didn't have anything connected to the HDMI socket that is faulty.
