    I stopped paying mine, after being informed the CCA is unenforceable.

    You could check out this option.

    Following this advice is stupid, you will end up with a trashed credit report. All an unenforceable CCA agreement means is the bank can't take you to court, not that you don't owe the money.

    Admittedly though, if you're on a DMP, it may not make much difference. But I would strongly consider whether you'd be willing to have defaults on your file (which are nasty little b*ggers at the best of times and will stay there for six years.)

  • Would anyone be willing to post a rough update about the last 6 months to save me hours of catch-up. Last time I heard peeps were getting no where with Santander OR FSO.

    I complained early last year to Santander re rate rise, was turned down, opened a FSO complaint but never got round to formulating it (life got in the way). I know Im probably too late for FSO complaint now but was wondering what was happening...

    I think I'm probably the last guest to the party. Have only just come across this discussion yesterday while googling Santander complaints. I took out my Cahoot flexi loan for £11.5k in 2003. I had my rate hiked to 20% by Santander takeover and have only just paid the whole thing off. Well I thought I had. Whilst applying for a mortgage, broker raised that there's a blight on my Equifax. I'd moved and rang Santander to let them know change of address. Presumed I'd paid everything off as never received any more of their crappy paper statements, but alas no - £200 still owed. I paid it immediately upon this news and raised a complaint. Santander denying I ever contacted them and rebuffing my complaint saying it is "resolved".

    Don't think I have ever experienced such arrogance and rudeness. God knows how much money they've made from me. Makes me sick.

    Denza, I am happy to contribute to the fight to get compensation over this now that I'm strong and have my own money again.

    Yes, a 4 month late payment marker and gone away / delinquent status. I hope it doesn't ruin my mortgage application. Everything else on my file is perfect. I was hoping for a friendly conversation and apology but it's been the opposite. They say I have to prove I called them as they have no record of it. I'll never consider any product from this bank - I never went with them in the first place, it was Cahoot. That's the galling thing.
    I'll send a PM to Denza to show my commitment to fighting the rate hike. I hope we can get some justice.
  • Plenty of people seem to get mortgages even with a couple with settled defaults, via a broker.

    If you would like to annoy Santander, send them a SAR. Might get something back you can use to help with removing the Late payment marker.

    Too late to help with your mortgage though I expect.

The only information I have is the account number. What is the likelihood I can still make an application for a PPI claim even if I am not 100% sure I had it on this loan. What is the best advice to go forward on this?

    They should keep records for 6 years minimum.

    Account number, DOB, address are all they need to find your account.

    Options I see:
    1. Write to them, asking if you had PPI. not sure what they would say.

    2. Send them a subject access request. Takes 40 days, they should send everything they have on you and that account.

    I would go with option 2.
