    Quick update:

    Haven't had a chance to read the board or check email but can now confirm that Slater & Gordon will now be reviewing the papers without call for any initial fee.

    How does this impact those of us that we're lucky enough to get refunds but the rate remained the same high one on the rest of the balance?

    Hi HB,

    No idea to be honest but if things progress then I will ensure that all questions in this area are addressed.

    Last year I got a tentative offer to pursue a class action with a firm through an acquaintance who suggested that previous successes with either Santander directly or via the FOS (back in the days when they had integrity!) would not prohibit inclusion in the litigation.

    Unfortunately my acquaintance has now left the firm and indeed the country so I am not confident that the offer remains on the table. However on the basis of that feedback it seems feasible that everyone would be entitled to participate - though please note that I have absolutely no idea if that is the case at this time.

    Very much my pleasure.

    Until the Courts tell me otherwise I believe that we are entitled to financial redress.

    This belief was in fact shared by both Santander themselves and also the FOS for a brief period so it can't be that wide of the mark now can it!?

    Update : Papers dispatched to S&G today.

  • I found this thread possibly too late. The enthusiasm of the early posts seems to have disappeared. Am I to assume that Santander stopped/never gave refunds?

    They paid out some then stopped.

    Denza is looking to take Santander to court, so worth you complaining to Santander then the FOS.

    1. To annoy them.

    2. To exhaust the complaints process in case that's required before being able to get anything from court action.

    Am new to this site. Seen this link via a google search as I too took out a cahoot flexi loan in 2006...(still paying for it today).
    I seen that back in 2011/12 some people had some joy in getting interest back from this loan, so thought I best give it a go.
    I called Santander to get as much information out of them as I could (the words blood and stone spring to mind) and then proceed to send a complaint email to every Santander email address I could find. Less than a week later I had a response from my complaint saying that they were satisfied with the T&C's I agreed to and would not be taking my complaint any further... so I complained about their response. They said when they took over the handling of my account in 2008 they emailed me to offer fixed rate products at lower interest rates that I could of transferred over to penalty free, but because I never took this option up presumed I was happy. I received no email! I complained that I never received such email offering other products, which they replied it was not a offer, just a promotion email. I asked for them to provide me with my signed CCA but they have written back saying that for some reason they cant produce it.
    I'm now going to go down the FOS route and was wondering if any of you kind people who had great joy with the FOS might still have a template letter they could share?? I figure I only get one shot at this and need to get it right.

    Oh, does anybody else's flexi loan have an end date of 12-12-9999??? only recently noticed this and still makes me chuckle.

    I think mine says 999 years on my credit report.

    No CCA is interesting. They had mine from 2001.

    Did you send a CCA request and £1?

    No I didn't. I just asked them for it via the complaint. They provided me with a copy of my CCA from a fixed rate account I had before I took out the flexi loan and said that's the only thing they could find.

    On the plus side, I complained about the PPI separately and today I got a very nice letter back offering me ££££ which more than covers the loan amount I still owe :-))
