  • Aside from the unfair rate rises, several on this board have identified issues with their statements, how coincidental that similar issues forced Northern Rock Asset Management, Barclays yesterday and Clydesdale today to pay back money. I think we need a concerted push in this area, and for people to reopen their complaints or start new ones.

    Any board experts on statements and compliance with the consumer credit act.

    Either Slater & Gordon will come back with some tangible interest first or I will pursue the small claims case once I get the funds*.

    If I can find the time to dig out any other prospective legal representation then that remains an option... suggestions welcome.

    I have also been rejected by Santander and the FOS.. Seems to me that the FOS are just a silent partner of our corrupt financial establishment...

  • I am new to this thread. I too have just had my disabled cousin's ( I have power of attorney for her) complaint thrown over by Santander. Reading here about the FOS I don't hold any hope of this being upheld by them either. I can't understand how both Santander and the FOS can have changed their attitude to the same complaint. Could someone please tell me their reasoning on this? Have I missed reading something on here or something because surely once they have refunded to some people that has set a precedent that they can not wriggle out of?

    I too thank you all for not giving up and still pursuing this. I want to join the fight too!

    Basically, because Santander didn't put up an argument to the first few as it's too expensive for them. I was one of those.

    Once everyone started, they defended it with the FOS and the FOS rolled over like a puppy in their favour.

    Though I am in complete agreement I would have phrased it rather differently and in language that would have offered far less savory imagery than that cute and cuddly puppy!

    However despite obvious disappointment for myself and others who were late to the party I am genuinely glad that many were able to partake in the Santander punchbowl before it was withdrawn.

    Still, onwards and upwards. Let's get this party restarted!

    My smalls claims case is waiting the wings and needs only to be funded to fly. I am happy to do this myself and it will probably be easier so am merely waiting for the capacity to do so which is currently tied up in property which is on the market.

    In the interim wishing a Happy Flexible Christmas and a prosperous New Year (at the expense of Santander Claws) to all on the board!

  • I have a new twist to this one - I went through the usual route and got the standard brush off from the FSO etc, and have now gone through a debt management plan for this account and some other debts. The other 3 accounts (including an overdraft on a current account from santander) have agreed to suspend interest charges and other charges to allow me to pay off my debts over 4 years. However....this loan Santander have firstly taken several months to respond, then finally stated that the interest rate was fixed at the beginning of my loan agreement which I had signed up for....errr...hello? no it wasn't, which was my point all along - I have tried to email them to ask for confirmation of my loan agreement where this is stated and tried to point out that I am taking positive steps to clear my debt etc, but there is a real sticking point with this particular loan it seems. I have just re-sent this email as I had no response since I sent it on the 3rd Dec.
    Really annoys me as they are willing to do this for the account I am paying off? They are getting regular amounts of money which is not far off how much I would normally pay, yet the 16.6% interest means half of what I'm paying goes straight back on interest> I'm really banging my head against a wall - not knowing where to go next?
    Anyone any suggestions?

    I stopped paying mine, after being informed the CCA is unenforceable.
