Thats a real shame. If I could claim back ALL my charges for the last 25 years of adulthood, I wouldnt need to do the Lottery any more lol.

I have just started going through the process of reclaiming by bank charges but have hit a metaphorical wall. The bulk of my charges were when i was a student and a little less worried about personal finance. However, i left uni 7 years ago, so 6 years back payment just aint gonna cut it. Can they go further back or am I floggin' a dead donkey? any help would be greatly appreciated, thanks0

I've read a few threads that have said that it is possible to claim back charges for a period longer than 6 years ago - but that it was more difficult.
Can anyone give me any guidelines or advice on where to look for the info? I have all the bank statements and letters I wrote to the bank at the time.

There is a law that only lets you claim back from the last 6 years. Cant remember which one it is though. Im sure other MSEers will be able to tell which law it is.

My husband closed his Barclays Account in June 2004, because of the charges. Can he back date the claim 6 years to June 1998?0

This is the legislation you need to use to reclaim further than 6 years.
32 Postponement of limitation period in case of fraud, concealment or
mistake
(1) Subject to subsections (3) and (4A) below, where in the case of any
action for which a period of limitation is prescribed by this Act,
either--
(a) the action is based upon the fraud of the defendant; or
(b) any fact relevant to the plaintiff's right of action has
been deliberately concealed from him by the defendant;
or
(c) the action is for relief from the consequences of a
mistake;

Hi There! I am attempting to get my son's charges back... I know that the Unfair Terms in Consumer Contracts Regulations 1999 is one piece of relevant legislation but I know there are others.... I understand that there is a six year time limit is thought to be as much as you can claim back and cannot source the legislation (whatever) that places this limit. I have been given to believe that separate legislation could mean that claims can go back to opening the account. Does anyone know what this further legislation might be?
Finally, I am aware that you cannot claim back the "usage Fee" for an overdraft facility but these cost vary radically from the original £6 up to a matter of £60 and the cost appear to be amounts. My son does not recall signing any further agreements after the first... Anyone know if these could be deemed illegal too?

Hi,
Well as the title says, is there anything that can be done with charges that are OVER 6 years old ? We got heavily charged in 2000 but we came to an agreement in 2002 to pay them back over a period of time and indeed paid them off 2 years ago.
Do you think we have a chance to claim any of this back ? All thoughts welcome !
