There is a lot of talk of claiming beyond the 6 years suggested on this site. How long does the bank have to keep your records under the Data Protection Act? Why does the Limitation rule not apply? Are there any templates for people that have already claimed or are in the process of claiming the last 6 years? Any ideas?

Hi Lee
It is theoretically possble to claim back further than the 6 year period but the legal arguments are more complicated and not as solid as the 'within six year' procedure.
If you are going down this road make sure you thoroughly research your legal position and know what you are doing.
I personally wouldn't risk it!

Would it be possible to claim the 6 years worth, then when it's safely in your pocket try for the older charges?0

I can't find anything specific about claiming more than 6 years of charges on the site through searching. What are people's thoughts on this? A friend told me they had read that this is now worth trying

Hi
You can only go back 6 years by law, and no more it's something to do with a law known as the Limitations Act, I think, if you through the threads other people do post about it."I AM THE GATEKEEPER OF MY OWN DESTINY" Nacho Libre

Can anyone tell me why the limit is for 6 years of bank charges to claim back.
Over the years I must have paid thousands in fees to different banks and would love to try and get some of it back.0 -
I think the 6 years is the amount by law that the banks have to provide statements for.0

Good question. I don't know where the figure comes from, but it has been the law for as long as I can remember. I wouldn't want it increased though - have you seen 6 years' worth of itemised telephone bills! The acquisition of wealth is no longer the driving force in my life.0
