Wasn't told it was a write off - Options?

    Speak to the garage first, they may have received the car in as a P/X, purchased through an auction or was a members of staff's car.

    Keep us updated though.

    I think they may have bought it at an auction because the owner before me was from over 40 miles away.

    Either way, it is the duty of the dealer to make sure that they are selling a roadworthy car. The car has been clocked by a good 20,000 miles and they failed to disclose when asked directly that the car is a Cat C.

    I will keep you guys updated. I'm sending the dealership a letter today. Not expecting anything back though. There were two companies that got closed down for 'clocking' cars in July this year. However, one of them appears to have opened near by under a different name. That is the company I bought mine from unknowingly :(

    40 miles away isn't that far for a PX or even a staff car, I travel 35 miles to work and bought my last car from about 60 miles away.
    Rather than write them a letter, why not just go in with all the details and tell them you want a refund as you were mis-sold a car

    Just because its a write off and clocked does not mean it is unroadworthy.

    A clocked car is not unroadworthy? News to me. The fact that it is illegal and makes the car illegal would suggest it is very much unroadworthy from that point of view. Maybe not mechanically but definitely by law.
  • a clocked car means the mileage has been changed, where does that mean it's unroadworthy? it means somebody has either replaced the clocks or wound them back.

    it also isn't illegal to clock a car, maybe to sell one without informing the new owner but not to actually clock a car. It may have even just had the clocks changed for some reason

    Of course its road worthy, a car does not even need a working odometer to pass an MOT, my Dad has a car that has had 17 MOT's with the mileage reading 37000.

    Its not a mini is it? I remember going with a flatmate to buy a 'low mileage' mini in Birrmingham 25 years ago. The car looked OK, until I started leafing through the old MOTs, and found that every one showed 37000 and a bit. Part of the odometer wasn't clicking the next numeral over, and it was destined to read 37000 for the rest of its life.

    Clocking a car doesn't make it unroadworthy. A repaired CatC car might be roadworthy, or might not. It would take a very close look to be sure either way.

    A dealer selling a clocked car without declaring it can be prosecuted.
    A dealer selling a cat C car without declaring it can be prosecuted.

    Your tale is unfortunate and there's no real defence re the clocking. Unless I've missed a change in the law there's no requirement for the dealer to declare the CAT C status unless you ask directly - did you do this ?
