Wasn't told it was a write off - Options?
Options
Hi all,
I bought a 2001 TT in April this year. When I bought the car my head was all over the place due to personal issues, seeing it on the forecourt I just had to buy it.
Everything was going perfectly, until last week when I decided to sell for a more fuel efficient car (personal situation has changed so need to drive over 30 miles to work).
I decided to do a HPI check to print off to show people who came to look at the car to show them that it was all clear.
When I did it this morning, it shows that the car is a Category C write off and it looks like it has been clocked, because the DVLA milage reading on 12 JUL 2010 shows 98,000 on at the time.........it is now showing 86,000
I wasn't told that the car was a Cat C when I bought it, in fact I was told that the car is in perfect condition etc, never had anything wrong. What are my options?? Am I able to take the car back to the dealership or not?
Absolutely gutted about this
Thanks for any help,
Liam

Is the garage still in business? See Trading Standards, and show them your evidence.0 -

Yes, they're very much still in business. Just checked their website. Spoken to TS who advised to send them a letter advising of this and that I wasn't informed at the time and to ask for a full refund. They said they'll probably offer me the difference of a Cat C car to a non Cat C car, but I'm going to pursue for a full refund.0 -
The garage should have told you it was on VCAR. Unless it was in the advert.
If you had bought it privatly then it'd be your loss.
I once looked at a car and thought it was a bit too cheap and couldnt find anything wrong with it until I read the description over and over again. At first I just thought it was poor/sloppy typing, but this is what it read...
airconditioning alloy wheels power steering remote central locking catd alarm front fog lights cd player...
They seller had put "catd" between central locking and alarm, making it out to look like it had a fancu insurance apporved alarm! When infact it was a CAT D car...0 -
Does it mention anything on the V5? my old cat D had a not on regarding the registration not being trasferable.0

Was it not marked on the logbook as a cat c??“Quis custodiet ipsos custodes?”

That is really sneaky. Whilst I suspect it would be a hard push to prove any intention to deceive, but certainly could be pulled up for misleading advertising.0 -
I've spoken with AutoTrader who have sent me to original Ad and there is nothing in there to state it is a Cat C:
"AUDI TT 1.8 T QUATTRO 2DR [225] GLOSS BLACK ALL, 2 Doors, Manual, Coupe, Petrol, 2001 51 Reg , 85,000 miles, Red. Stunning Red TTC 225 Full Black Heated Leather Sport Seats 17 Inch Gloss Black Alloys 3.2 Front Vented Bumper Colour coding - Body, Colour coding - Interior, Climate Control, ABS, Headlight washers, Folding rear seats, Immobiliser, Passenger airbag, Radio/Cassette, Sports seats, Traction control, Alarm, Body coloured bumpers, Drivers airbag, Electric door mirrors, Front electric windows, Front fog lights, Front head restraints, Heated door mirrors, Height adjustable drivers seat, Isofix child seat anchor points, PAS, Remote central locking, Steering wheel rake adjustment, Steering wheel reach adjustment, Trip computer, Space saver spare wheel, Heated front seat. Insurance Group:18, 85000 miles Choice of Two Similar Vehicles"
Not only does it not say anything about the Cat C but they fail to mention that it's mileage has been altered.
I've just been on the dealerships website and it states:
"All cars receive a HPI Check"
Which means they cannot say they didn't know it was a CAT C.
It doesn't state directly that it is a Cat C on the log book, however there is a note of significant damage at the bottom of it. However I didn't receive the log book until after I bought the car.0 -
Unless they are colossal chancers they will want to buy it back in. They will be well aware from their checks and the V5c that it wasn't right and they already know they have broken the law.0
-
I have also found that the mileage has been altered or 'clocked' by a good 20,000 miles. I have had VOSA issue me all previous MOT's and for the last 3 out of 4 the car has been recorded with 90,000+ miles. The last one at 98,000. I bought the car with 85,000 on the clock0

Speak to the garage first, they may have received the car in as a P/X, purchased through an auction or was a members of staff's car.
Keep us updated though.0
