    I rang MCOL and they said "don't worry, don't do anything yet, we are sending you a letter anyway advising you not to cancel the claim just yet, ring us when the cheque arrives or ring us when it doesn't arrive in the next 2 weeks and we can bring it further." I like them! :)

    Hi all my question is this
    I have 2 claims in HfC for £1100, HSBC for £3600.
    HFC judgment day falls on saterday 14th April and HSBC on easter monday 9th April, as both of these fall on a non working day do I have to waite for a work day to file for judgment, if their 14 days is up on the 14th, do I have to waite until the 15th to ask for judgment.

    From MCOL FAQ....

    Q. I am entering judgment by default but a message comes up stating you cannot enter judgment by default at this time, why does it say this?

    A. This is because the defendant's time for filing a response has not yet passed. If their deadline fell on a weekend or bank holiday they are given the next working day to respond. It may also be because the defendant has filed an acknowledgement of service, which gives them an extra 14 days to respond.

  • hi, hope someone can advise me, filed MCOL and today it has been Acknowledged, i know this gives barclays a total of 28 days but does anyone know how barclays usually proceed from here, not looking forward to a court appearance xxx thanks

    just put my claim in on MCOL my question is
    does anyone know how long have they got to put a defence in
    and if they do how long after that before it goes to court
    just a rough guide of what to expect next

    Hi Greeny,

    The claim takes 5 days to be served. Then they have 14 days to either acknowledge/defend the claim. If they acknowledge this will bide them an additional 14 days on top to make it 28 days in total. If they defend within the 14 days then a court date could be set for a couple of months.

    For example Lloyds court dates are being done in July :mad:

    You never know your bank may not respond at all in which case you win and can enter a judgement by default.

    No worries bud,

    Yea I'm in the process with Lloyds too.

    It does seem a bit sureal, I filed through MCOL on the 21st March and they have just acknowledged my claim :mad:

    I don't understand why they drag it out because we will get our money back in the end including interest + costs :T
