    Have you had an answer to this question? (about claiming the remaining amout of charges after been given a goodwillgesture)
    I've asked the same but no one has replied !!!
    Capital one have wrote to me also today and offered half the amount as a goodwill offer, but I still don't know how to claim with MCOL for the remaining amount.

    Please can someone HELP, PLEASE!!!!!!

    On the last page of the MCOL form - where it states that a signature is needed - what do I have to do with that - do I just type in my name????

    Just type Initials and Surname
  • Nationwide acknowledged my claim on the 13/3/07. Do they have 14 days from that date before i start the judgement or do i have to wait the whole 28 days from when they were served?

    Hi all, sorry i had originally posted this elsewhere but i had no reply and i badly need advice before continuing:confused:

    Im about to take the plunge and file my claim online with MCOL. My first 2 letters went off to HSBC as outlined here and the only response being the standard reply letter they send saying they will look into the matter

    So now im ready to actually submit my claim but my major concern is that since my first letter was sent the 6 year period you have with which to make a claim has expired with 3 of my charges which with interest total approximately £100. Now my overall claim with interest is £403 and it would be a large portion to lose if im now unable to claim for those 3 charges

    As my first letter to HSBC demanding money back was recieved by them prior to the 6 years being up would a claims court take note of the date i submitted my initial demand? I have other charges due to go over the 6 year period shortly and its become a race against time for me

    Now do i submit my claim minus the expired charges or continue to claim for the whole lot as i got the ball rolling and HSBC received my first letter prior to the 6 years?

    I have seen posts where the banks have written to the claimant stating they will be defending as the 6 year period was up - any solid advice on this will be very very welcome as i need to submit my claim ASAP

    Keep the charges in - it is a small amount so they will prob pay up, but if it goes to allocation then in your AQ mention the Stautes of Limitations Act section 32 (concealment) to enable you to keep those charge in your claim.

    I have put in a claim for £1600 against Barclays. When I review my case , under judgment is says start. When I click on start the following comes up:


    Do you wish to enter Judgment by Default or by Admission? Please select one of the options below:


    The defendant has not filed an admission or defence to my claim
    (Judgment by Default)

    You will need to decide, how and when you want the defendant to pay. You can ask for the Judgment to be paid by instalment or in one payment.


    The defendant admits that all the money is owed
    (Judgment by Admission)

    If the defendant has given a new address on the form of admission to which correspondence should be sent, update the defendant's details within the following Judgment request.


    Do I need to do anything here?

    Only when the 14 days (or 28 days if the defendent has filed an acknowledgement) is up do you then make a decision. Click on judgement by default and you will see it won't let you at this time and will explain all.

    QUESTION FOR johnny_alpha
    How did Barclays enter their acknowledgment? Did they send you a letter or does it show up on MCOL?
    My 14 days are nearly up and i've heard nothing from RBS, does this mean i just enter judgment by default and they have to pay up?
