    This is a "standard" defence from the banks, don't worry about that one. You'll find a guide to the Allocation Questionnaire in the Reclaim Help Thread, which is linked in my signature and if you have any questions regarding filling it in pop them in this thread...

    Hi, i am about to start a mcol against capital one.just need help with a couple of things,
    since sending my first request and a letter refusing difference of charges/ lba i have changed my name and address with capital one. will this affect my mcol. should i send letters all again or proceed with mcol.
    also miss calculated and have also had more charges since original request should i resend letters or can i just add to mcol?

  • Hi guys,

    My claim was issued on the 12th March - implied 'served' date of the 17th March.

    As of midnight 01 April Fool's Day (ie 31st March has come and gone) I should have been able to hit 'Judgement by Default' - but zip! In fact the website apologised to me all through yesterday and today - saying that 14 days must be allowed since the date it was served - help!

    My claim still shows as 'issued' - should this have moved on?!

    I wanted it in the courts today but now that's a day lost (and possibly allows the bank to sneak an acknowledgement in) - what could be going on?! :confused:

    I believe that if the 14th day is on a weekend then they get another day to the Monday.

    Hi, im about to take the plunge and file my claim online with MCOL. My first 2 letters went off to HSBC as outlined here and the only response being the standard reply letter they send saying they will look into the matter

    So now im ready to actually submit my claim but my major concern is that since my first letter was sent the 6 year period you have with which to make a claim has expired with 3 of my charges which with interest total approximately £100. Now my overall claim with interest is £403 and it would be a large portion to lose if im now unable to claim for those 3 charges

    As my first letter to HSBC demanding money back was recieved by them prior to the 6 years being up would a claims court take note of the date i submitted my initial demand? I have other charges due to go over the 6 year period shortly and its become a race against time for me

    Now do i submit my claim minus the expired charges or continue to claim for the whole lot as i got the ball rolling and HSBC received my first letter prior to the 6 years?

    I have seen posts where the banks have written to the claimant stating they will be defending as the 6 year period was up - any solid advice on this will be very very welcome as i need to submit my claim ASAP

    Just about to file MCOL against Barclays, but wondering about amount of money to claim. Barclays have already credited account with goodwill gesture of £72 half the original amount (£144). Do I now only claim the difference as I already have half? (sorry I know this sounds stupid but I just want to get the MCOL filed correctly)

    Hi, sorry if this is a daft question but i have issued my claim thrr moneyclaim and it has been presented to Barclays and they have until 4th April to acknowledge etc but if they dont do anything and i win by default (wishful thinking maybe) do i do this ON the 4th or do i have to wait till the 5th as they could still acknowledge until pressumably midnight on 4th? Hope this makes sense - all help appreciated. Jo

    I think it's the fifth, but they will not let you enter judgement too early anyway so if you try on the 4th and it's too early you won't be able to and have to try again the next day.
