Court claim

We are now at the stage when we need to file against Abbey for my youngest son. Really concerned that we need to get this right from the start so can you recommend where to look to do this and what needs to be stated etc. I have seen the claimant note page on this site but need more guidance please.
On a happier note my oldest son has had his offer in writing today from Nat west after the 2nd letter stage. Only £100 less than requested and no closure of account etc. Glad we decided to keep trying.0 -
MCOl claim was issued about 10 days ago and I have suddenly just spotted a mistake!! I double checked the word document that I prepared the claim in and its correct in there so I dont have a clue what has happened.
Basically the section you into the 'Particulars of Claim' when claiming interest should read:
The claimant claims interest under
s.69 of the County Courts Act 1984 at rate
of 8% a year from 09/03/2001 to 19/03/2007 of £331.78
and it actually reads : from 09/03/2001 to 19/03/2001
which means we are trying to claim 10 days interest!!
Does anyone know how we go about getting this error amended?:heart2: Cookiepops :heart2:0 -

Barclays offered me today £1000 as final settlement with their letter bla bla bla. They want me to signed accepting this offer as a full and final settlement of my complaint against them. My claim is for £1740.51 this icludes
£1365 - charges
£255.51 (Interest till 26/3)
£1620.51(Total )
£120 (Court fee)
Total £1740.51
Can you accept this as a part payment, do you ammend the receipt theyve send me or send anopther letter or ignore them
Please some advice on this!!!!!!!!!!:j0 -

Hi my mcol claim was acknoldged by halifax on the 22/3/07, recently got in the post a copy of the acknowledgment which has a box saying 'i intend to defend all of this claim' which is 'ticked'. Do I write letter 5 (Refuse offer)
"Thank you for your letter dated 30/03/2007. I respectfully decline your offer of Full and Final settlement .
You may not have been aware that I commenced legal action against you for the full amount plus interest and costs on 26/03/2007 and I would ask that you now refer this matter to your legal department for further instruction.
Alternatively, should you wish to settle my claim in full, then please forward the balance of the claim (£1740.51) without further conditions and I will inform the court that the claim is settled."
When do I send this they will be waiting for 7 days to accept the settlement (that I am not going to accept of course)

Nat West Bank - Reclaiming £576.09 (15 days into MCOL with acknowlegment received)
Nat West Credit Card - Reclaiming £360.13 (15 days into MCOL with acknowlegment received)
MBNA - Reclaimed £55.38 paid in full after 14 days of filing claim with MCOL
Alliance & Leicester (mortgage exit fee) Reclaimed - £295 paid £210 after 12 days of one phone call0 -
Is it vital to include the date you opened the account in the template as I can't find the details?

Do you actually mean the 29 January 2007 ??
If so and they haven't put in a defence you should ask for judgement.
The acknowledgement of the claim just means the intention to defend, and they get 28 days from date claim served as opposed to 14 days.
If no defence made then you ask the court to award you judgement by default once the 28 days are up.0 -

The Halifax have 28 days from when the claim was served this is 5 days from when the claim is deemed issued, you should have received court papers telling you the specific dates of these.
If they do not defend after 28 days you ask for judgement.
If they do defend the court will send the allocation papers to you for completion.0
