    From MCOL FAQ...

I am entering judgment by default but a message comes up stating you cannot enter judgment by default at this time, why does it say this?
    A. This is because the defendant's time for filing a response has not yet passed. If their deadline fell on a weekend or bank holiday they are given the next working day to respond. It may also be because the defendant has filed an acknowledgement of service, which gives them an extra 14 days to respond.
  • will i be able to see somewhere on the moneyclaim site whether or not they had filed anything.
I have not received anything through the post.

    Cheers EG

Beate, I think you should calculate interest right up until this minute and add a note that any more delay will make it go up even more. They owe it you and thats exactly what they would do to you. The banks would be totally merciless if it were the other way round.

Isn't that what I did and what I told Taffyfella to do? Or have you mixed the two of us up when answering?

Try this (same version edited). Edit the parts in bold, and enter the dates as XX/XX/XXXX..................

The Claimant has an account XXXXXXXX (put your account number)with the Defendant, opened DATE. Since DATE the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

Lilili I think it will be 28 days on the 17th of march. You add on 5 days from starting process then they have 14 days from there, extended to 28 if the acknowledge / enter a defense. So 12 th feb add 5 = 17th feb, add 28 days = 17th march..hang on in there !!

Same to Jimmyjamjar 5 days from you starting process add on 14 more days.
