Not contacted the bank since requesting judgement, tried to but permanently engaged.
Yes, have had confirmation from the court that default judgement has been granted.“A budget is telling your money where to go instead of wondering where it went.” - Dave Ramsey0 -
Okay a quick letter to the bank then to say I have default judgement against you you will have received an order from the court when you going to pay or am I going to have to resort to bailiffs.......
then sadly they'll probably respond with a set aside request....or they might just pay up.
OR
just go straight in with your bailiff warrant - but be warned its not a quick job....hagenUK wrote:they write to the defendant first, then do nothing for 8 days, then write again, are not allowed to enter premises by force and will almost always leave empty handed having struck a deal with the debtor.
In cases where the defendants do pay, the money is held by HMCS for a further 14 days in case the payment is reversed and then it is paid to the claimant by the court, but many courts only issue cheques once a week therefore you may suffer yet further delays.

Hi all - i'm in the process of completing my MoneyClaime online forms and have got stuck on my bank address i.e. when i put the address in (which is in Basildon, Essex) it says - 'The address details you have provided are outside of England and Wales'. This obviously isn't the case! Do i need to put a 'Head Office' address in??
Thanks!0 -
You should use the registered address for your bank which is in the second post in Reclaim Help Thread, link in my signature.0

Hi & thanks for your super quick reply!
My registered address appears to be in Edinburgh, as i am with RBS, so does this mean i can't use MoneyClaim Online as it is outside England & Wales. If so, could i use my local branch address ?
Thanks0 -
In that case use your branch address and from MCOL FAQ....
Q. The system is stating the address is not within England or Wales but it is, why is it saying this?
A. This may be because you have entered England, Wales or Uk in the address field which is not recognised by the system. If that is the case please remove them.
Q. The address search was unsuccessful but I know the address entered is correct what should I do?
A. There is an option to select 'I want to use the address I entered myself'.0 -
Just a thought as you are with RBS who are settling pretty quickly, have you tried phoning them again?0
-
I haven't actually phoned them yet. All i've done is send of my 2 letters, of which i've heard nothing from my first one about 4 weeks ago, and head down the MCOL route. Do you think i should phone them and ask if they've received my letters etc?
You say they are settling fast, that sounds hopeful!0 -
Morning all
I have filled out the MCOL forms and it shows that it was Issued on the 05 March, when I click on this it say - 'Your claim request has been accepted. The Defendant has 14 days from the date they are served with the claim, to reply'.
I havent heard anything from the bank and after reading thru this thread some bits are saying they have 28 days to file a defence
Do I start a judgement now or have to leave it for 28 days? As the bank havent responded does that mean I just automatically win?
Im a bit worried cos I didnt fill the particulars of claim bit in with the template, I just wrote a little paragraph. And I am claiming against Barclays and HSBC and its a bit funny that neither have defended?
Can anybody help please, thanks0 -
Thanks Esmerellda. I will write to them then.
