As a rule RBS are settling on the second letter although someone yesterday said they had been told the standard, we have 8 weeks to sort this.

I would definately spend a bit of time phoning today and if you don't get the "right" answer from the first person, try phoning again a bit later.

    Cool.
One last question, can you point me in the right direction for calculating charges etc. I'm at the particulars of claim stage and im claiming back £5k worth of charges. How would i calculate this for interest reclaiming?

You won't get any offer including the interest as this only become applicable at the court stage but what you need to do for MCOL is use Martin's Interest Calculator, link in the article and you input each charge with the date it was taken and it will work out the interest for you. This works out that a charge taken in 2001 will incur more interest than a charge taken in 2006.

Matt - You count 19 days from the issue date (thats 5 to get it going plus the 14) if the last day lands on a weekend or bank hol then they get the following Monday aswell.

    Yippppppppeeeeeeee
I have now requested judgement on mine. I have also been trying for ages not knowing what the score was but it has done it now. Me and the wife did it last night about five past midnight. I know its not in our hands yet but last noght was like scoring a goal at a football match. We are one goal up.

The thing with me is that when they were putting charges on my account (in error) they were also putting bad credit references on my credit file.
It all depends on the circumstances but people can get bad credit damage from these bank nobs.

Thanks Esmerellda. I will write to them then.

What is a set aside request?

Basically the bank pretends (allegedly) that they didnt know anything about the claim and have a good chance of defending successfully (which they don't) so the judge grants them further time to submit a defence, thus canclling out your default judgement.

All my time reading this forum and I never knew that. What a waste of time. Lets hope a letter does the trick as I've read others have been successful when approaching their bank at this late stage.

    Hi,
Today was the 14 days deadline for Woolwich / Barclays to acknowledge our claim which we lodged with MCOL.
As yet, we have heard nothing, but are half expecting a letter tomorrow morning, as it sounds like they reply on the last possible day ... GRRRR !!!
My question is, how long do you think I should leave it before proceeding? If I hear nothing tomorrow, should I put a judgement in (and also, am I right in thinking that I have to cough out another £100 in addition to the £120 I have already shelled out?). Should I assume that they will post the ackowledgment by 1st class post today do you think???
Any advice / past expereriences are v. welcome!!!

    Thanks!
