The Claimant had an account 4627854007701209 with the Defendant.Since 28/05/2003 the Defendant debited charges and interest in respect of purported breaches of contract.A list of charges has already been supplied. Claimant contends a)The charges exceed the Defendant's losses caused by the breaches;(b)The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law.Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982.7.Claimant claims return of the amounts debited of £140.00 Plus interest pursuant to S.69 County Courts Act 1984 of £34.44 continuing at £0.032 per day until settlement.LegalBeagles0

cheap-n-cheerful wrote: »Lilili I think it will be 28 days on the 17th of march. You add on 5 days from starting process then they have 14 days from there, extended to 28 if the acknowledge / enter a defense. So 12 th feb add 5 = 17th feb, add 28 days = 17th march..hang on in there !!
Thanks for that cheap-n-cheerful - I will wait till the 17th and see what happens, if anything!
Will let you know how I get on.
Cheers, Li

Make sure you have no additional whitespace at the end and remove the space between sentences. It usually the number of lines that's the problem.0 -

1.Between 28/03/01 and 9/02/2007 the
Defendant applied numerous default charges
to the Claiment's bank account. It is
understood the Defendant contends the
charges were debited in accordance with its
contract with the Claiment.2.The charges
applied are a unfair penalty under the
Unfair Terms in the Consumer Contracts
Regulations, which state.A term is unfair
if it requires any consumer who fails his
obligation to pay a disproportionately
highsum in compensation. The amount does not
reflect the cost of the breach.
3.Under the law of penalties, the charges
are an unlawful penalty.A charge is a
penalty if it does not reflect an item's
true cost.
4.Under the County Courts Act 1984, the
claiment is entitled to interest at the
rate of 8% per annum from the date they
were first deprived of the money. This
totals £752.71 continuing to accure at the
statury daily rate of 0.021% until
judgement or payment.
5.The Claiment therefore asks the court to
enter judgement in their favour for
£3193.50 plus interest,totalling £3946.21
this is what i am putting in and ,as martin said i hav typed it in myself, but it stiil wont let me do it!!ahhhhhhhhhh!!0
