    Had anyone got to the stage that a defence is filed - Lloyds have files a defence angainst me and i was wondering how the banks normally played it??

    Can somebody please help me? I have just completed the online form to reclaim the charges and it says that we have to wait 14 days, is that 14 working days or normal days?

  • Hello, This is my first post on this site, but read it all the time. I am claiming £2200 from abbey and have done the moneyclaim bit and the claim was acknowledged on the 21st March, saying they were defending it. The case has been moved to my local court and when I called them last week they said that they are still awaiting a defence from abbey. I make the 28 days are up today, I am not sure if I am meant to do anything now as can't look on line as can't remember password, can anyone help who has been through this!!!!

    I'm hoping someone can help me out with this..I started the process of trying to claim back £3409 back from Nationwide. I rcvd the standard letter back saying that these were under the terms and conditions of my bank blah blah, so I sent the 2nd letter threatening court action.
    I heard nothing from then so started the moneyclaim process which they acknowledged on the 14/03/07.
    They said they intended to file a defence but nothing was done, so on the 28th day I tried to start the judgement on mcol and it came back to say that I could no longer deal with my claim online as a defence has been submitted! (on the 12/03/07..???!! Is this possible a defence was submitted before it was acknowledged?)

    I called mcol helpdesk this morning who tell me that it has now been transferred to my local county court and now I'm a bit worried what will happen next...Any suggestions? Has this happened to anyone else?? :mad:

    I am afraid a lot of banks defend last minute, usually just to bide time. They do not have any intention to go to court, believe me. And yes, the date next to "Defence" reverts back to the Issue Date, I found that peculiar as well. Just sit tight. You will get an Allocation Questionnaire next, I believe - or a cheque from Nationwide.

    I can only tell you my story - Capital 1 sent us a letter saying they would send a cheque for the full amount within the next 14 working days. On the basis of that they defended the claim to bide time, so we got a notice from the court "Notice of Defence that Amount Claimed Has Been Paid". They gave us a month to reply to this notice and say whether we wished to proceed with the claim or not. The cheque finally turned up last week so we put it in the bank and will send the form back tomorrow saying we do not wish to proceed.

    If they defend the validity of the claim as such, you will get an Allocation Questionnaire which you have to fill in and send back. I do not know the timescales for that, sorry.
