Moneyclaim Online (MCOL) question

    Morning!

    Well today is the 28th day for Nationwide! There is no money in my account and as far as I can see from MCOL there is no defence either. So..........do I wait until tomorrow and try to start the judgement? Would it let me know on MCOL that a defence had been filed? or do I need to ring the courts?

    Can anyone help.........Thanks

  • I have tried on my claims to start the judgement process before the 28 days and the MCOL system will not allow it so I would say if the system allows then go for it.

    My claim was aknowledged on the 23/3/07. Does the 28 days include the 23rd, or start from the 24th?

    Does anyone know??

    Have a look through the 'Claimants guide' at MCOL - see this page. If you're not sure, you can ring up MCOL on 0845 6015935 and they'll be able to advise you. I'm still learning all this myself, so don't want to give you duff advice !!

    You just ring the court. But wait till you have the money in your account! Personally, I wouldn't do this, because once you start a claim, you are entitled to the full amount + interest + court fees.

    Just log into your claim on MCOL. It will say whether the bank has defended or not. And if you are not allowed to enter judgement yet, it will not let you (the court sometimes allows a few extra days due to weekends, and don't forget that it's 28 days PLUS 5 days from when the claim was issued -that's the time the court allows for the claim to be deemed served).

    It does not matter when it was acknowledged. Count 5 days from the date your claim was ISSUED (for it to be deemed served), then add 28 days.

    I was just wondering if on the bottem where it says total amount claimed (where they work out ya court fees) do you think i could get away with puting down the amount with out the interest?
    as my total with out is £4925.00 & would cost me "only" £120 in fees, with interest (total 5626.70) would cost me £250 in fees!! _pale_

    My claim was aknowledged 2 days after it was issued.......does that mean i have to wait even longer now as i presumed it was 28 days after the aknowledged stage?!
