We've ignored all the letters so far (4 in total) and today my girlfriend panicked when the letter stated that they were going to recommend to the landowner that they take her to county court...

And I'm going to recommend to Asda that they provide me with free groceries for the rest of my life...

Actually I'd be surprised if the contract Asda have with Not-so-Smart Parking allows them to take their customers to court. Imagine the response if word got around that Asda were taking their customers to court for committing the heinous crime of, er, shopping at Asda. I'm sure the likes of Tesco, Morrisons, Sainsburys, etc would more than willing to ensure those court cases were very well publicised ;).

It would be interesting if anyone knows of anyone who has been actually been taken to court over a parking "offence" "committed" on an Asda car park as opposed to just being threatened with it.

luckily she only gave her card details and NOT made the payment, so i have had her cancel the card as STOLEN so it's now blocked and they can't take payment.

    should get more interesting...

now i typed up a miffy letter, is it worth sending it off, or just cut contact with them again as they will no doubt add further money on the 'charge'

and yes that was the letter on the link above she got..

    thanks all

    Miffy letter, who to???

try something to the local ASDA coomplaining about your treatment by theor contractors who are using multiple names, and the letters, which are nothign short of harrasment have caused stress, upset, loss of sleep etc etc, and that if they do not stop sending threats you will seek advice on pursuing that ASDA branch for harrasment as that ASDA branch is responsable for the actions of their agents - in this case Smart parking/TCP/what ever they are calling themselves.

If you are talking about a letter to a debt collector. NO.

As you will see in all the 'same old' threads if you click on the links I posted (as SchoolRunMum on pepipoo) on that link I gave you earlier. Please sit down with your gf and click on all the links I posted on that pepipoo thread, see how commonly this letter is received, how commonly people say 'OMG shall I reply because I got this letter from DRP?' and how commonly I yawn and reply and say NO.

Do not engage with the 'debt collector' call centre scammers AT ALL.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Even better, send it to Tony Wilson at Asda HQ....telling him that any lack of action on his part will result in the follow up being LBA addressed to Ellie Doohan. That is guaranteed to get a response.

My son has just received a fixed penalty charge from Smart Parking. Photo's say he entered Asda carpark at 5.33pm and left at 19.56pm. He was playing squash across road, went in to get water, then his Dad went back up to Asda later that night. There are two exits. We don't have the money to spend 2 and a half hours shopping in Asda anyways!! :(

So ok..he shdn't have parked there in 1st place but now not sure what to do? Shd he pay the £40 for early payment...as its £70.

Any advice would be very welcome. :)

Or should he just ignore and get on with his life?

That's what i'd do. However, just keep an eye on the junk mail that follows, highly unlikely but they might just sneak Court papers in there. As i say, highly unlikely because they'd have some explaining of their own to do.

Thanks. I don't know what to do. We don't have any receipts from that night and he's just turned 18 and I don't want him to have anything on a credit file which may affect his future credit etc. Suppose he will have to pay it. Sigh. That's our family NEVER shopping at this store again and we usually do all our weekly shop here.

This will not effect his credit rating, does he have a credit account with Smart Parking or ASDA? Because the only way it could effect his credit rating is if it went to court he lost, and refused to pay the judgement. That is extremely unlikely to happen in the first place, and impossible to happen without his knowledge.

As he's just turned 18, was he 17 when he parked ? If he was he cannot enter into any agreement such as the one smart says he did, so the whole thing would be invalid. Let us know

He was 18 on Sunday. I don't know what to do. No he does not have any credit account with either. Thanks for your help.
