  • The plan originally was to take one day off as holiday as the item had tracking so that I would know what day to stay at home. Unfortunately it didn't turn up for nine days and the courier Hermes even tried to call the driver which he hung up on them. Everyday he took the item the depot and just didn't even attempt to deliver and then would return it every day back to the depot.
    The letter I sent which was attached was from the template I found on the MSE website.
  • zax47, I am assuming you used ebay advanced search to get my work address. If you googled it you would understand why I wouldn't get it delivered to a place of work that manufactures and refurbishes military planes/ vehicles.
    My issue wasn't that it was in the allowed timescale but that each day they promised me it would be delivered the next day. I wouldn't of been bothered if it arrived late as long as I had one delivery day not nine.
    FYI the letter was based on the template from the MSE website.

    Nope, just good ole fashioned Google - the pretentious bit led me straight to you (think about it - try for yourself). It was unnecessary to include it and along with your middle initial made you easily identifiable. In your occupation, with your employer, you need to be more careful (I'm very well aware of them, and their work/contracts as I'm a supplier). This is something I tell all my lads, given the various arena we operate in. There are times when it is appropriate to quote your "credentials" - an email to eBay, copied on a public forum, isn't one.

    Bit of a not-straightforward one, wouldn't mind some guidance.

    I'm getting my phone repaired under insurance - this is what's coming in the package. I haven't paid for the phone (it's already mine!) - I'm not sure if this changes things.

    I got an email from DPD on Monday (around 4pm) telling me my delivery will be due on Tuesday 12th January. I rearrange my day and meetings to make sure I am at home for the maximum amount of time to receive my phone. I use and need my phone for business.

    On Tuesday morning, at around 6am, I get an email telling me that my parcel will be delayed till Wednesday 13th January. I've already re-shuffled a day of work, and now I have to do the same on 0 hours notice.

    Now It's Wednesday, and it's coming up to 10am and I haven't received a "your parcel is out for delivery" email yet, so I'm starting to doubt it's going to turn up even today.

    I need my phone by lunchtime tomorrow for a business trip and I'm worried I won't get it.

    Do I have a case here?

  • I ordered a parcel which claimed free next day if I spent over £80, I did easily. I also forgot to add a few items so ordered through the same company but had to pay for delivery on the second order, that too claimed to be next day.
    The following day I received a text informing me my parcels would arrive between 15:38 and 16:38. This never arrived leaving me waiting in all evening. I contacted the website that I ordered through who responded with they attempted delivery and I wasn't in. When I argued this and asked for proof they responded with the driver had run out of time and clicked the wrong thing on his machine saying he had attempted delivery by mistake.
    The second day I received a text saying my parcel would be delivered between 19:06 and 20:06! So again I waited in. Now I am a self employed beauty therapist, I only work evening currently as I have 2 young children. I had to cancel appointments to be in at this time! I waited for my parcels again for them not to arrive!!!
    I emailed the company at my disgust of next day delivery still not arriving!!
    I received yet another text informing me my parcels would arrive on the 3rd day between 10 and 11am. So again I cancelled appointments to wait in for this parcel. Loosing yet more work and more money! They parcel finally arrived 3 days after I ordered! I've lost £160 on those 2 extra days waiting for a parcel that should have come on my day off!
    Where do I stand with this?

    Hello Mrs Merrick, welcome to the forums.

    Does the article mentioned in the open post on this thread not explain exactly where you stand?

    In a nutshell, if the failed delivery has caused you losses, then the sender should compensate you for that.

    There are caveats though.

    You should make every effort to keep you losses to a minimum.
    For example, cancelling appointments to receive a parcel may not be the best way of minimising your losses.

    At one point you say "I only work evening currently as I have 2 young children". Is that so someone else is at home looking after the children during the evening? If so, why did you have cancel appointments to stay at home for the evening delivery?

    Then you say you had to cancel appointments to wait for a mid-morning delivery - but you only work evenings, remember.

    Yes, it certainly seems like the sender's carrier has messed you about, but you need to get your story straight before pursuing any claim.

    I bought a pair of shoes from Daniels Footware. They offer free delivery and use UK Mail. Their terms and conditions don't specify that it is signed for delivery.

    UK Mail notified me that they were going to delivery on a Wednesday when I was out a lot. They gave options to change delivery date, address or leave in a safe place. I added a safe place which is out of view of the street, at a basement door.

    I received a notification that the parcel had been delivered but when I got home it was not there and there was a note saying it had been left at the "step door". There was no parcel at my premises.

    Daniel Footware claim that they have no liability because I chose not to have a signed for delivery and UK Mail claim they have no liability because I requested a safe place. Neither website notified me of signed for delivery or mentioned that I would not be covered if I chose a safe place.

    I believe that the retailed has an end to end responsibility to get the product to me and to notifty me of terms and conditions related to delivery. I have complained and they will not refund. Any suggestions?

    What do you think happens if an item is left 'safe' and goes missing?
    Unless the safeplace is similar to a lockable parcel safe,this is always going to be a risk.
