It is not "UK" DSRs, it is EU DSRs. Therefore, the regulations apply.
Really? I thought EU regulations were merely guidelines - it is what is enshrined in law in the member countries that takes precedence. Thus I thought DSR was a UK law (albeit based on an EU regulation).
Hence why we have the The Consumer Protection (Distance Selling) Regulations 2000 - a UK law. Whilst I suspect ROI has a similar law, which one applies in such a case (ROI consumer buys from UK seller)?0 -

The buyer is in the UK and the seller is also based in the UK.
From what I understand, the DSRs are Europe wide.The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

I bought a camera from a shop in Leeds area who told me it was sent last Friday 9th Dec via Royal Mail Special Delivery which should arrive by 1pm next day - in this case Saturday 10th, and they provided me with a tracking number.
According to tracking information it was delivered at 09.16, the signature is not a signature - looks like a 2 yr old was given the pen. and the printed name is MR, no one in my house has these initials. Somebody was in all day saturday but the parcel was not delivered.
I contacted the shop where I purchased the item by cheque, they had insisted on either cheque or bank transfer - wouldn't accept CC - the shop has said categorically it is not their problem and that I should contact Roayal Mail, who were more helpful and have instigated an internal enquiry.
Who is responsible for claiming against Royal Mail for the failed delivery? I am out of pocket to the tune of £550 for the camera that didn't arrive and the shop aren't prepared to do anything about it!0 -

The retailer is responsible. It is them who sent it and therefore has the contract with RM. Your contract is with them -- until the parcel is delivered to you then they are responsible!
Did you order online then? You can also cancel under distance sellign regulations whereby their required to refund within 30 days. The only problem being the fact you paid by Cheque which makes things harder.
Let RM investigate and get back to you, then get the shops response in writing.. then it may be a case of small claims court.0 -
thank you Flyboy152 I don't seem to be getting any responses now. I emailed last week, not had a reply and have just emailed again. meanwhile I have been putting together a break down of timescales etc I don't feel I can let this go.
This has been going on since 18th October. Almost 2 months now. Was 3 weeks before they informed me there was a problem with the delivery, I gave them the details again plus a phone number. I also emailed the delivery details again and checked the order to make sure I had given the correct details, which I had. It was then 5 weeks until they told me the item had returned to the warehouse and would I like a refund or replacement.0 -
ABSOLUTELY SHOCKING CUSTOMER SERVICE!!
In short I am one VERY angry customer! I ordered on 06/12 an HP laptop - once I added it to the basket it went downhill from there:
1) wouldn't add my 10% discount as a new customer - which in my fault does say not for electrical items
2) wouldn't allow me to collect it from somewhere near work and then charged me for delivery
3) ordered it before 8pm expecting a next day delivery - but the onscreen confirmation said Thursday
I had to call at 10am on the Thursday to be told this hasn't been processed...so immediately not happy - but was still expecting delivery on Thursday. I was at home having taken a days leave and waiting for the package to come. I checked the "track my parcel" to find out it hadn't been dispatched so called Very. I have just been told there is an issue about the item from the supplier which means it won't be delivered and there is no idea when it will be delivered - yet at time of order WAS in stock with a confirmation of delivery date…I have asked for a call to know what is going on...to date I am still awaiting this call.
In short this is a tragic, almost comical script of poor customer service which has lead me to tell the nation not to believe in a Very merry christmas.0 -

But the delivery address is NOT in the UK, so this may complicate matters. Also, the poster does not say they are in the UK, just that the delivery address is ROI. You have inferred they are in the UK.
Only by the fact that why would they say that they were charged double for sending something to the Republic. I am on the brink of never ordering online again. This year I have had SIX deliveries go amiss.
Briefly:
Play.com: two items ordered 21 Nov, never arrived. They said I signed for them, did not, Two long phone calls to someone who could not speak English, compensation form emailed and returned but after a week just rang them and told they can do nothing until Monday 19 December - so too late to get the items for Christmas, my poor kids. Terrible customer service. Now have emailed them to complain generally about their service
Republic: £105 worth of goods, stayed in all day 13 Dec as had text, HDNL website says it has been delivered. Rang HDNL 14 Dec and they said they'd call me within 24 hours. Nothing. Rang them today got better answer, they are waiting to interview van driver. Rang Republic very competent man says he will call within 24 hours.
Lakeland: Two items did not arrive. Called v helpful customer service who said they had had problems with deliveries and would resend them without any fuss. Sadly one item was then out-of-stock so got offered an alternative and part refund. Good customer service although disappointed that deliveries did not arrive.
eBay Son wanted Angry Birds hat for friend's birthday! Ordered 1 Dec - never arrived. Emailed on 12 Dec, got full refund from good eBayer but he said he had sent it and was giving money back as goodwill gesture.
Just really wondering where all these items have gone...0
