    You have paid in a 1/3 more over the years yet expect 100% back?

    Or does your wife have great savings?

    i told you why she wont pay.

    and all your other points are totally irrelevant to me when you consider i refuse to lose the house or at least get 100% back because im the only one who has ever contributed to it.

    How long have you been married/living together? this is what will determine whether she has a share in the house.

    Pinkprincess posted about interviewing for JOBS....are you really not going to consider one of them until the mortgage protection ceases?

    There is, by law, a right to live in the house as the matrimonial
    home and your lawyer can protect that right quite simply.
    A divorce court will not be concerned about whose name
    the house is in. It will simply be regarded as an asset of the
    marriage. The law notes who paid the mortgage but it is
    not relevant to who has rights with regard to the house
    ...........

    i agree with you

    which is why its imperative i do everything to protect the asset i own, to make sure she cannot lay claim to it. if that means classifying her as a lodger to maximise benefit so be it. im happy enough to be classified as seperated from her.

  • The problem you have are these are separate issues. You can protect the house and if you decide to divorce then you go through the motions. If you want her as a lodger after the divorce fine.

    BUT

    DWP will not accept your classification of lodger and assume you are a couple trying to maximise benefits (which you have just admitted). Benefits has nothing to do with protecting your house during a spilt.

    If you are happy enough to be separated then I suggest you tell your wife that and get on with the divorce papers.
